The relationship of OK 016-94 and Classifier classes

It can be noted that between the objects of the Classifier, which was introduced by the Decree of the Gosstandart on the approval of the list of professions and positions, and those that are present in the Classifier of occupations, it is assumed that there are links that allow the former to be assigned to a particular group within the list to which the latter belong . That is, each position - a worker or an employee, as a rule, can be assigned to a certain category of occupations.

However, it should be noted: taking into account the fact that such concepts as “occupation”, “profession”, and also “position” differ significantly from each other, the employee of the personnel department of the enterprise who uses the Classifier in question may need to use explanations to individual groups of the Classification of occupations - in order to determine the unambiguous relationship with its objects of those positions that are provided for by the considered official list of professions and positions.

Each profession is important and distinctive. A person of each specialty has his own designated tasks, salary, characteristics of the workplace, ranks, etc. At each enterprise there is a system of bonuses and punishments, the specificity of professional activities, etc.

Qualification Handbook

To determine the classification of posts and instructions, there is a special unified qualification reference book. Abbreviated ETKS, approved on the basis of a decree of the Government of the Russian Federation. Thanks to him, enterprises form personnel activities. According to the content of Article 143 of the Labor Code of the Russian Federation, qualifications of professions and duties are made on the basis of a single tariff-qualification reference book.

The classifier provides a list of posts for each economic sector, determining the terms of reference and the rights of an official or employee.

The use of the classifier of professions allows each organization, enterprise to streamline the work process, clearly distribute responsibilities in the work collective, and comply with labor laws.

Being legislative acts in the labor legislation, the Labor Code and the classifier are approved with reference to each other. This indicates that a violation of the provisions of the classifier of professions will be the basis for a violation of labor law and administrative misconduct. When organizing personnel activities at enterprises, a single list of working professions is taken as the basis for the formation of posts, the labor hierarchy, and the reward and punishment system.

The classifier is constantly being improved; amendments are being introduced that are necessary in connection with a change in the country's economy. However, these nuances are not significant and practically do not concern the main list of posts.

The list of professions and the classifier of posts is the most important tool of labor law, personnel service of any enterprise, acting as a guarantor in the organization and remuneration of almost every employee.

This section presents the issues of a single qualification directory of positions of managers, specialists and other employees (hereinafter - CEN). CEN is intended for tariffication of works and assignment of tariff categories. On the basis of the TSA, it is possible to write job descriptions and programs for the training and professional development of specialists in various industries and fields of activity. Decree of the Government of the Russian Federation of October 31, 2002 N 787 established that the TSA consists of the qualification characteristics of the positions of managers, specialists and employees, containing job duties and requirements for the level of knowledge and qualifications of managers, specialists and employees.

The development of the TSA is carried out by the Ministry of Health and Social Development of the Russian Federation together with the federal executive bodies, which are entrusted with the management, regulation and coordination of activities in the relevant sector (sub-sector) of the economy (clause 2 of Decree of the Government of the Russian Federation of October 31, 2002 No. 787). Decree of the Ministry of Labor of the Russian Federation of 09.02.2004 N 9 approved the Procedure for the application of the TSA.

The qualification directory of the positions of managers, specialists and other employees is a normative document developed by the Institute of Labor and approved by the Ministry of Labor of Russia dated August 21, 1998 N 37. This publication includes additions made by resolutions of the Ministry of Labor of Russia dated December 24, 1998 N 52, dated February 22, 1999 No. 3, dated January 21, 2000 No. 7, dated August 4, 2000 No. 57, April 20, 2001 No. 35, dated May 31, 2002, and dated June 20, 2002 No. 44. The directory is recommended for use at enterprises, institutions and organizations of various sectors of the economy, regardless of ownership and legal forms in order to ensure the correct selection, placement and use of personnel.

The new Qualification Handbook is designed to ensure a rational division of labor, to create an effective mechanism for the delineation of functions, powers and responsibilities on the basis of clear regulation of the labor activity of workers in modern conditions. The directory contains new qualification characteristics of employee positions related to the development of market relations. All previously existing qualification characteristics have been revised; significant changes have been introduced in connection with the transformations being carried out in the country and taking into account the practice of applying the characteristics.

In the qualification characteristics, the standards for regulating the labor of workers have been unified to ensure a unified approach to the selection of personnel of appropriate qualifications and compliance with the unified principles of rating work based on their complexity. The Qualification Characteristics takes into account the latest legislative and regulatory legal acts of the Russian Federation.

Qualification reference book for managers, specialists and other employees

General Provisions

1. The qualification directory of the positions of managers, specialists and other employees (technical executors) is intended to solve issues related to the regulation of labor relations, providing an effective personnel management system at enterprises * (1), in institutions and organizations of various sectors of the economy, regardless of ownership and legal forms of activity.

The qualification characteristics included in this issue of the Handbook are normative documents intended to justify the rational division and organization of labor, the proper selection, placement and use of personnel, ensuring unity in determining the job responsibilities of employees and the qualification requirements presented to them, as well as decisions on compliance positions held during the certification of managers and specialists.

2. The construction of the Directory is based on an official attribute, since the qualifications of employees are determined by their official duties, which, in turn, determine the names of the posts.

The directory is developed in accordance with the accepted classification of employees into three categories: managers, specialists and other employees (technical executors). The assignment of employees to the categories is carried out depending on the nature of the predominantly performed work constituting the content of the employee’s labor (organizational and administrative, analytical and constructive, information and technical).

The names of positions of employees whose qualification characteristics are included in the Directory are established in accordance with the All-Russian classifier of occupations of workers, positions of employees and tariff categories OK-016-94 (OKPDTR), entered into force on January 1, 1996.

3. The qualification guide contains two sections. The first section describes the qualification characteristics of industry-wide positions of managers, specialists, and other employees (technical executives), which are widely distributed at enterprises, institutions, and organizations, primarily manufacturing sectors of the economy, including those that are financed from the budget. The second section contains the qualification characteristics of the posts of workers employed in research institutions, design, technological, design and survey organizations, as well as editorial and publishing units.

4. Qualification characteristics at enterprises, institutions and organizations can be used as direct regulatory documents or serve as the basis for the development of internal organizational and administrative documents - job descriptions containing a specific list of job responsibilities of workers taking into account the specifics of the organization of production, labor and management, and also their rights and responsibilities. If necessary, the duties included in the characteristics of a particular position can be distributed among several performers.

Since qualification characteristics apply to employees of enterprises, institutions and organizations, regardless of their industry affiliation and departmental subordination, they present the most characteristic work for each position. Therefore, when developing job descriptions, it is allowed to clarify the list of works that are characteristic of the corresponding position in specific organizational and technical conditions, and the requirements for the necessary special training of employees are established.

In the process of organizational, technical and economic development, the development of modern management technologies, the introduction of the latest technical means, the implementation of measures to improve the organization and increase labor efficiency, it is possible to expand the range of responsibilities of employees in comparison with the established corresponding characteristics. In these cases, without changing the job title, the employee may be entrusted with the performance of duties stipulated by the characteristics of other posts that are similar in content to the work, equal in complexity, the performance of which does not require another specialty and qualification.

5. The qualification profile of each position has three sections.

In the section “Job Responsibilities”, the main labor functions are established that can be assigned in whole or in part to the employee holding this position, taking into account the technological uniformity and the interconnectedness of the work, allowing to ensure optimal specialization of employees.

The “Must Know” section contains the basic requirements for the employee with regard to special knowledge, as well as knowledge of legislative and regulatory acts, regulations, instructions and other guidance materials, methods and tools that the employee must apply in the performance of official duties.

In the section "Qualification Requirements" the level of professional training of the employee necessary for the performance of the prescribed job duties, and the requirements for work experience are determined. The levels of required training are given in accordance with the Law of the Russian Federation "On Education".

6. The characteristics of specialist posts provide for within the same position, without changing its name, intra-job qualification categorization of remuneration.

Qualification categories for remuneration of specialists are established by the head of the enterprise, institution, organization. This takes into account the degree of independence of the employee in the performance of official duties, his responsibility for decisions, attitude to work, work efficiency and quality, as well as professional knowledge, practical experience, determined by the length of service in the specialty, etc.

7. The Qualification Characteristics of Derivative Positions (senior and leading specialists, as well as deputy heads of departments) are not included in the Directory. The job responsibilities of these employees, the requirements for their knowledge and qualifications are determined on the basis of the characteristics of the corresponding base positions contained in the Directory.

The question of the distribution of duties of deputy heads of enterprises, institutions and organizations is decided on the basis of internal organizational and administrative documents.

The use of the official name "senior" is possible provided that the employee, along with the fulfillment of the duties stipulated by the position held, manages the executives subordinate to him. The position of "senior" can be established as an exception and in the absence of executors in the direct subordination of the employee, if he is entrusted with the functions of managing an independent area of \u200b\u200bwork. For the positions of specialists for which qualification categories are provided, the official name "senior" is not applied. In these cases, the management functions of subordinate performers are assigned to a specialist of the I qualification category.

The duties of the "leading" are established on the basis of the characteristics of the respective professional positions. In addition, they are entrusted with the functions of a leader and responsible executor of work in one of the areas of activity of an enterprise, institution, organization or their structural units or responsibilities for coordination and methodological management of groups of performers created in departments (bureaus) taking into account the rational division of labor in specific organizational -technical conditions. Requirements for the required length of service are increased by 2-3 years compared with those provided for specialists of the I qualification category. Job responsibilities, knowledge requirements and qualifications of deputy heads of structural divisions are determined on the basis of the characteristics of the respective managerial positions.

The qualification characteristics of the posts of heads (heads) of departments serve as the basis for determining job duties, knowledge requirements and qualifications of the heads of the respective bureaus when they are created instead of functional departments (taking into account industry specifics).

8. The compliance of the actually performed duties and qualifications of employees with the requirements of the job characteristics is determined by the certification commission in accordance with the current regulation on the certification procedure. At the same time, special attention is paid to high-quality and efficient performance of work.

9. The need to ensure the safety of life and health of workers in the course of work puts forward problems of labor protection and the environment among urgent social problems, the solution of which is directly related to the compliance by managers and every employee of an enterprise, institution, organization of existing legislative, interbranch and other regulatory legal acts on labor protection, environmental standards and regulations.

In this regard, the official duties of employees (managers, specialists and technical executives) along with the performance of the functions provided for by the relevant qualification characteristics of the position provide for mandatory compliance with labor protection requirements at each workplace, and the official duties of managers provide healthy and safe working conditions for subordinate performers, as well as monitoring their compliance with the requirements of legislative and regulatory legal acts on labor protection .

When appointing a post, it is necessary to take into account the requirements for the employee to know the relevant labor safety standards, environmental laws, norms, rules and instructions for labor protection, collective and individual protective equipment against the effects of dangerous and harmful production factors.

OKPDTR  - The all-Russian classifier of professions, positions, tariff categories.

What is OKKDTR

In fact, it is a directory with codes that determines whether a worker belongs to any group. It was introduced in 1994 instead of the All-Union Classifier of Specialties (ACS). The need to replace the old document is justified by changes in the economy, the working environment. This served as a means of achieving consistency in the standards of Russian accounting and statistics with international ones.

The code contains information about:

  • employee affiliation with workers or employees;
  • the nature of the work he performs;
  • applicable tariffs;
  • skill level;
  • method of payment;
  • severity and harmfulness of work;
  • level of automation of the workplace;
  • job categories;
  • place of staff in the hierarchy.

Classifier Tasks

  1. Collection and synthesis of information about all professions and positions available in the Russian Federation in a single structure.
  2. Creation of a statistical report on the state of the labor market.
  3. Assessment of the state of the workforce by qualification.
  4. Analysis of working conditions and wages.
  5. Accounting for the number of workers employed in various fields of activity.
  6. Integration into the global statistical system.
  7. Identification of the secondary educational level to create conditions for retraining, improving the professional level of personnel.
  8. Ensuring the correctness of entering the names of posts and professions in the documents when hiring staff.

Where and by whom

It is used in the production environment, wherever workers and employees are recruited. Assign it immediately when applying for a job. The code is reflected in the documents of the accounting and personnel department. Most often use it in such cases:

  1. When drawing up documents: an employment contract, a personal T-2 card, an order for dismissal, and assuming office. They include OKKDTR.
  2. To make decisions on the payment of compensation, the application of benefits.
  3. Definition of the name of the future position, based on its characteristics.
  4. Positioning in the staff list.
  5. Providing reports on accruals to the pension fund.
  6. Assignment of service pension.

What sections and blocks consists of

The classifier is divided into two main sections:

  • by workers;
  • for employees.

Workers include employees directly involved in production. They do the work that results in a real product. The place of work can be a workshop, workshop, a house under construction, etc. It is usually equipped with a large number of technical equipment, inventory intended for working with materials. The main resource in the work of the worker is physical strength and good health. Payment for many professions is piece-rate. Working hours depend on the nature of the activity. It can be installed at any time of the day. For example, road construction is carried out at night. Higher education is not required for such work.

Employees are administrative staff. These include accountants, managers, secretaries, any other office professionals and management team. They work with information. The main resources of an employee are intelligence, knowledge, and specialized education. The workplace is equipped with a telephone, computer, fax on the table. The work schedule is clearly specified, set once, when hiring, is fixed in the employment contract. Opening hours are daytime. The positions of employees are taken after graduation.

Three blocks in classifier positions

  1. Identifying.  It is a composite code that includes five consecutive digits that make up the number and one separately - the control number. The first encrypted information about the profession or position. The next four are just a serial number in the registry. The control number is determined on the basis of a unified methodology for its calculation.
  2. With the name of the object.  Each code corresponds to the name of the position or profession. It is subject to use in the form in which it is given, and cannot be changed in the organization that uses it at will. Names are arranged alphabetically.
  3. Informational.  It contains codes called facet codes. They indicate the correspondence of the profession code to the ETKS tariff codes and codes of the old OKZ classifier.

Faceted codes reflect the following features and characteristics of professions:

  • 01 - varieties of work and production activities;
  • 02 - categories of tariffs;
  • 03 - skill levels;
  • 04 - terms of payments for labor;
  • 05 - working conditions;
  • 06 - equipment;
  • 07 - professions in production.

Is it mandatory to apply OKKDTR

The need to use a classifier with respect to a specific staff unit is directly dependent on the conditions set forth in the employment contract. And the mandatory components of this type of contract are governed by the provisions of Art. 57 of the Labor Code of the Russian Federation. In accordance with the article, it should include information about the employee's labor function:

  • a list of specific tasks required to be performed at the position;
  • work,;
  • specialty;
  • profession;
  • qualification.

If the norms of federal law provide for preferential conditions, compensation payments, limiting factors for a certain position or profession, their names should be used unchanged in accordance with the OKDTR or other directories and provisions of the Government of the Russian Federation containing standards. Mandatory conditions, for example, may be:

  • pension;
  • the presence of harm or hard work;
  • additional vacation;
  • inclusion of a category at tariffs in relation to employees;
  • application of tariffs in relation to work.

Case law

Mr. N. worked under a labor contract as a mechanic. Changes took place in the company, and by decision of the management N.'s department was renamed, contracts with employees were renegotiated. N. was acquainted with the new job description for signature, but did not agree with the innovations regarding his position. It did not suit me that while working as a mechanic, in addition to his previous duties, he was also required to perform the functions of a cleaner, a security guard. Documented requirements were recorded in the job description. Expressed dissatisfaction orally. The authorities did not accept his point of view. N. filed a lawsuit because he believed that the requirements of the leadership did not comply with the characteristics established in the OKDTR for the position of mechanic.

The court did not satisfy the claim, explaining this by the fact that Art. 8 of the Labor Code of the Russian Federation allows organizations to independently develop internal regulatory documents.

Job description refers to internal regulations. There are Gosstandart rules that should be relied upon when creating a document. But the legislation does not establish strict rules for its development. Therefore, the employer has the right to introduce standards at its discretion, taking into account the specifics of the company and the requirements for the position.

Standards OKKDTR in some cases have a recommendatory nature. If, based on the characteristics of the activity, there is no need for them, no penalties are provided for. Moments at which the provisions of the classifier must be taken into account must be established by law at the federal level.
