The increase in the minimum wage to the subsistence level, planned for January 2019, which will entail an increase in the salaries of state employees, was decided to be implemented in 2018. From May 1, 2018, the minimum wage will increase immediately by 17.6% and will amount to 11,163 rubles.

Adjust the time frame for the entry into force of the provisions federal law dated December 28, 2017 No. 421-FZ was proposed by Russian President Vladimir Putin at the beginning of 2018.

“We have the opportunity to equalize the minimum wage and the subsistence minimum from May 1 this year, we will do it,” he said.

After discussing the issue, the Government of the Russian Federation decided to accelerate the increase in the minimum wage and equalize it with the subsistence level as early as May 1. Labor Code The Russian Federation provides for the procedure and terms for a smooth increase in the minimum wage to the subsistence minimum (Article 133 of the Labor Code of the Russian Federation). Such increases are established by federal law. Amendments to the law on the minimum wage were approved by Federal Law No. 41-FZ of March 7, 2018. The document contains amendments to Article 1 of the Federal Law of June 19, 2000 No. 82-FZ “On the Minimum Wage” and comes into force on May 1, 2018.

According to the law, the minimum wage must not be less than the subsistence minimum for the 2nd quarter of the previous year. In 2017, the minimum for the working-age population in the designated quarter was approved in the amount of 11,163 rubles (Decree of the Government of the Russian Federation of September 19, 2017 No 1119). Accordingly, the minimum wage in Russia from May 1, 2018 will be 11,163 rubles.

The salary of state employees from May 1 will exceed 11 thousand rubles

The implementation of the Federal law on the minimum wage is mandatory in all regions of Russia, so many employers will need to increase the salaries of employees by 1,674 rubles. The amount of salary may be below the minimum wage, but in the amount of incentive allowances, a percentage of sales must exceed the federal minimum wage.

The Labor Code of the Russian Federation requires that employees receive at least the minimum wage per month. The salary of an employee who has fulfilled the labor norm per month or worked the norm of working hours must be at least the minimum wage (Article 133 of the Labor Code of the Russian Federation).

However, it is not prohibited by law to pay people less than the minimum if they are not employed full-time. Perhaps employers will do just that: they will formally transfer employees to a reduced working week in order to not really raise wages.

The salary of workers who are involved in the regions of the Far North and equivalent territories, areas with special climatic conditions, will be increased by regional coefficients.

From May 1, 2018 separate categories Russians are waiting for an increase in the minimum wage to a level not lower than the subsistence minimum established for the able-bodied population. But to whom exactly will they raise them? We are talking primarily about state employees and those who received unfairly low pay for their work. Such a positive trend is associated with an increase in the level of the minimum wage, to which the wages of the listed segments of the population were tied.

First of all, it should be noted that Russian legislation There are 2 categories of state employees, whose remuneration is carried out at the expense of the state budget of the country:

  • civil servants (employees public institutions and organizations);
  • public sector employees (doctors, educators and teachers, etc.).

Since salaries and allowances are regulated by separate “rules” for civil servants and officials, we are talking primarily about other public sector employees:

  • teachers of kindergartens and general education;
  • teachers of secondary and primary education;
  • university teachers;
  • doctors;
  • middle and junior medical personnel;
  • cultural and social workers;
  • scientific staff;
  • teachers of medical, educational and other organizations that provide services to orphans.

Thus, the increase will affect those state employees whose salaries were tied to the minimum wage, and whose income level is still below the subsistence level. In many public sector organizations, the salary of an employee of the 1st category is tied to the level of the minimum wage, so they are waiting for a significant increase in wages. For example, in the field of education, the number of such employees is about 18% of the total.

The legislative framework

The increase in wages for public sector employees is due to an increase in the minimum wage (minimum wage) to the subsistence level, which is approved in Law No. 41-FZ, which President Vladimir Putin signed on March 7, 2018.

On a note! Previously, the minimum wage was set at 85% of the subsistence level.

From May 1, 2018, these figures will amount to 11,163 rubles. This is the minimum amount that a full-time employee can receive. But it should be borne in mind that the amount received “in hand” may be less after deducting personal income tax and other payments (for example, alimony).

At the same time, the salary itself may also be less than the specified amount of 11,163 rubles, since wage is formed from (Article 29 of the Labor Code of the Russian Federation):

  • salary as remuneration for work (can be set below the minimum wage, provided that the total wage for the full month is at or above the minimum wage);
  • compensation payments, including allowances and surcharges;
  • incentive payments (premiums and bonuses).

Important! Territorial coefficients and percentage allowances (for example, for the regions of the Far North) are not included in the amount of the minimum wage. The minimum amount of wages should not be lower than the established level before they are calculated.

The new law will affect the salary of about 4 million citizens, of which about 1.6 million are employees of the public sector. The final percentage of the salary increase will be determined in different organizations on an individual basis, but the main thing is that the amount will not be lower than the “minimum wage”. According to the preliminary calculations of the Bank of Russia, the average salaries of state employees will grow by 14% in 2018, which is more than 3 times higher than the forecasted inflation. Such significant growth rates of wages are planned only for 2018, in 2019 an increase of 4% is expected, in 2020 - by 4.3%.

To fulfill obligations, 39.3 billion rubles will be allocated from the budget: 31.8 billion will be used to increase the salaries of employees of municipal and state institutions of the constituent entities of the Russian Federation, and the remaining 7.5 billion rubles. - for employees of federal state institutions.

Uneven wage increases

Due to the peculiarities of federal legislation, which provides for differences in the minimum wage for individual regions, the level of salary increases will also differ. At the same time, it should be taken into account that if the size of the regional “minimum wage” is higher than the size of the federal minimum wage, then wages in the specified region cannot be lower than this regional indicator.
