December 25, 2019 Results of the first face-to-face session of students of the Master's program in forensic science

On December 17-23, the first full-time session of the Master's program "Judicial Financial and Economic Expertise" (direction - jurisprudence) was held. The master's program is implemented according to the network form of the PRUE. G.V. Plekhanov and the Expert Council Union of Forensic Experts.

The first group of masters includes 60 students from 19 regions of Russia. Traditionally, the face-to-face session was held in the recreation and sports boarding house of the Administrative Department of the President of the Russian Federation "Lesnye Dali".

The Expert Council continues to improve educational technologies that are used in the implementation of master's programs. In particular, the webinars were held with the full-time participation of teachers and students from the Moscow region. During the first semester, teaching material was presented in the form of webinars. The face-to-face session was aimed at practicing the necessary practical skills based on interaction between the Program participants.

Interactive forms, multi-format tasks - the richness of the session program was noted by all participants. It included the following blocks:

psychological training "Expert Stability";

psychological training "Psychology of behavior in the trial";

business game "Trial".

Psychological training "Expert stability (three axes: task, relationship, energy)" was conducted by a professional social psychologist (MSU), certified business coach, international NLP trainer Tatyana Muzhitskaya. The participants analyzed such components of the topic as real tools by which you can measure and change the situation in a 3D communication model; tasks (metamodel, logical levels); relationships (attitudes, technologists, masters); dissociation tools, reframing, self-esteem.

Co-founder of Soft Skills Law Academy, business trainer, NLP practitioner Anna Sorokina conducted a psychological training "Psychology of behavior in a trial", where she spoke about the communication field of a court lawyer, types and main subjects of communication, communication mistakes of a lawyer, revealed the secrets of establishing contact with a judge (how to become a trusted lawyer). The participants examined the types of judges and the peculiarities of communication with different types, touched upon the topic of the emotional intelligence of a judicial lawyer, worked out skills to increase resistance to negative emotions and aggression, performed a number of exercises to increase confidence and regulate the emotional background of the process.

Alexander Aleshin, Chairman of the Board of Non-Commercial Partnership “The Board of Auditors, Experts and Specialists,” discussed the topic “Interrogation of a forensic expert. Justification of the expert's position, work with case materials ”, revealing important aspects of interrogation and interaction of a forensic expert with the investigation to obtain additional research objects, and also spoke about the development of the methodology of forensic financial and economic examination.

The audience was greatly interested in the speech of a lawyer with 25 years of experience, who specializes in defense in economic criminal cases, Ph.D. Konstantin Shutov. In 2015, he led a high-profile case at the Urzhum distillery, which is interesting because several of the defendants in the case, including the appraisers who had been in jail for over a year, were fully acquitted. Konstantin Shutov told the audience about the basics, the specifics of the legal profession, about the fundamental concepts of the theory of law.

The listeners presented their research papers and discussed the directions of future master's theses.

At the end of the educational session, Vladimir Petrenko, partner of the Expert Council SROO, head of the legal advice office of the Moscow Region Bar Association, conducted a business game on the trial, in which a real trial was simulated with a preliminary distribution of roles between the participants.

The game of a new level, aimed at participants in criminal trials, turned out to be more complex than the games usually held in the trainings of experts within the framework of the master's program “Examination of evaluation reports”.

High-quality networking became a distinctive feature of the first face-to-face session of judicial masters. The first set of the master's program was completed by leading experts in the field of forensic science, and the session provided an excellent opportunity to communicate with their colleagues on current topics, discuss important trends and significant cases, and outline joint projects.

Intensive educational activities were interspersed with sports. The listeners gladly took part in the games of football, tennis and volleyball. And the final part of the session was held at a common table - on the eve of the New Year holidays, a friendly evening with prizes and gifts became the logical conclusion of the judicial expert week.

December 10 at the Congress Center of the PRUE G.V. Plekhanov, the Sixth All-Russian Forum of Appraisers took place. The annual meeting timed to coincide with the Appraiser Day brought together hundreds of participants from all over Russia. These included both the appraisers themselves and the consumers of appraisal services, representatives of relevant government bodies and structures, as well as representatives of related fields of activity.

Both full-time participants and the online audience listened with interest to the speakers who presented their points of view on problems in the assessment and the self-regulation system, including on legislative innovations, as well as options for their solution.

At the beginning of the event, Sergey Mikhailovich Katasonov, First Deputy Chairman of the State Duma Committee on Budget and Taxes, Deputy Chairman of the Working Group of the State Duma of the Russian Federation "Improving legislation in the field of cadastral valuation, property taxes and appraisal activities", emphasized the importance of valuation activities, which are closely integrated into various spheres of life - "The opinion of the professional assessment community is extremely important for the country's economy."

The main focus of the event was on the development of proposals, incl. on the introduction of legislative changes aimed at eliminating the identified problems: adjusting the form and content of the Qualification Exam, creating equal conditions for passing the Qualification Exam for all Appraisers, regardless of their location. The discussion was attended by Irina Mikhailovna Filippova, Deputy Director of the Department for Financial and Banking Activities and Investment Development of the Ministry of Economic Development of the Russian Federation and Alexey Sergeevich Bunkin, Director of the Federal Resource Center for Organization of Management Training.

President of the Association A.V. Kaminsky illuminated the current situation with the qualification examination. According to Federal Law No. 172-FZ of 06/02/16, all members of the SROO until April 1, 2018 are required to obtain a qualification certificate confirming the passing of a qualification examination.

In fact, professionals who stood at the origins of the industry are obliged to pass the exam on an equal basis with those who are just starting their professional path. According to the speaker, the situation is similar to the one as if the academicians were forced to take the Unified State Exam, and, in the case of getting fewer points than school graduates, they would be deprived of their title.

The President of the Association noted that the problem of the exam concerns not only the members of the assessment community, which numbers about 22,000 Appraisers. Taking into account related specialists in the field of appraisal, about 100,000 jobs have been created.

A significant problem lies in the extremely low intensity of taking the qualification exam. At the moment, about 600 Appraisers have passed the qualification exam, which is no more than 3% of their total number. Moreover, the numberpreliminary applications for the organization of qualification examination in the constituent entities of the Russian Federation exceeded 9,000! According to A.V. Kaminsky, with such an organization, more than 80% of Appraisers, mainly regional, will not have the physical opportunity to pass the exam before the deadline and, as a result, will be forced to leave the profession. In turn, this will lead to an increase in the cost of valuation services for the population and a deterioration in the economic microclimate for business.

The speaker drew attention to the delay in the start of the exam for more than 8 months. The exam was supposed to start from the beginning of 2017 in order for appraisers joining the SROO in 2017, in accordance with 172-FZ, to have a qualification certificate by 01.07.2017. The first exam was held on August 21, and the first qualification certificate was issued only on September 13. In fact, an action of civil disobedience is now being held, since none of the SROO excludes appraisers who do not meet the requirements of 172-FZ for the presence of a qualification certificate. A.V. Kaminsky emphasized the need to improve the procedure and content of the qualification examination: “What is this? Are we observing Agile at the state level? Or is it non-professionalism in terms of industry management? "

According to the President of the Association, it is necessary to postpone the examination deadline from 01.07.2017 and 01.04.2018 to 01.01.2019. This measure will allow the development of systemic proposals for amendments to legislation, incl. in the profile order of the Ministry of Economic Development and Trade No. 257 on the order of the exam, as well as prepare the infrastructure for taking the exam in the regions.

LLC “Expert Council” organized a series of educational and discussion events in various regions for the Association “Self-regulatory organization of appraisers“ Expert Council ”. The problems of professional appraisal activity in its various manifestations were discussed: changes in legislation, topical issues of real estate appraisal, Appraiser safety and preparation for the qualification exam. We also dealt with ready-made cases and non-standard situations that the Appraisers encountered in their professional activities.

1. Series of seminars "Topical issues of appraisal activities". The head of the Regional Development Committee of the Association Sergey Gorev held a series of educational events: April 20 in Penza, May 4 in Ufa, May 25 in Saratov, June 6 in Vologda and June 21 in Stavropol. Participants of the seminars received detailed information about the latest legislative changes, as well as answers to topical questions of real estate appraisal. More than 130 people took part in the events - members of various SROs, heads of appraisal companies, representatives of the banking sector and government agencies. A distinctive feature of the events was a question-and-answer session, during which participants had the opportunity to get answers to questions that are of particular concern to them. 2. On May 24, in Perm, a seminar was held on the topic "Actual issues of real estate appraisal." The moderators were the Executive Director of the Association "SROO" Expert Council "Maxim Ilyin and the Chairman of the Disciplinary Committee Mikhail Lapin. The participants of the event were especially interested in the problem of calculating the market value of capital construction objects to challenge the cadastral value. The event was not limited to the official part, therefore, discussions on professional (and not so) topics were taken out into nature. 3. On June 1, the InterregionalForum of Appraisers in the Chernozem region "Time Ch" was held. In the format of an open dialogue, Appraisers from various regions of the country discussed topical issues of professional activity, held panel discussions and exchanged experiences.

Particularly lively were the discussions around the report of the Executive Director of the Association Ilyin Maxim on the safety of the Appraiser. In view of the outlined in recent years a negative trend of bringing Appraisers to responsibility, including criminal liability, the need to form their legal protection has increased. The President of the Association, Aleksey Vladimirovich Kaminsky, examined in detail a number of landmark precedents, including the case of Olga Morozova and Lyudmila Danilina, Co-Invest Bryansk, TsFOK.

1. GENERAL PROVISIONS

1.1. This Regulation on the Expert Council of the self-regulatory organization "Union" Federation of Appraisers Specialists "(hereinafter - the Union) has been developed in accordance with the Federal Law of July 29, 1998, No. 135-FZ" On appraisal activities in the Russian Federation "(hereinafter - the Law on Appraisal Activities ), other regulatory legal acts of the Russian Federation, the Charter of the Union and other internal documents of the Union.
1.2. This Regulation establishes the status, purpose of activity, competence and structure of the Expert Council of the Union (hereinafter - the Expert Council).
1.3. The Expert Council is a body of a self-regulatory organization of appraisers, created to ensure the function of expert examination of reports on appraisal of objects of appraisal (hereinafter - the appraisal report).
1.4. The Expert Council in its activities is guided by the norms of the current legislation of the Russian Federation in the field of appraisal activities, including the Federal Law of July 29, 1998 No. 135-FZ "On appraisal activities in the Russian Federation", Federal appraisal standards, regulations of the authorized federal body, performing the functions of normative legal regulation of appraisal activities, as well as internal regulations of the Union.

2. COMPETENCE OF THE EXPERT BOARD

2.1. The competence of the Expert Council includes:
2.1.1. development of uniform requirements for the examination of assessment reports, the working conditions of the members of the Expert Council and their qualifications;
2.1.2. examination of assessment reports;
2.1.3. provision of consulting, methodological and other assistance to subjects of appraisal activity, customers of appraisal services and examination of appraisal reports, as well as to other persons;
2.1.4. other issues related to the activities of the Expert Council.
2.2. The procedure for the examination of assessment reports is established in the standards and rules of the Union.
2.3. The Expert Council carries out its activities in cooperation with the Disciplinary Committee and the Control Department of the Union, as well as other bodies and structural units of the Union.

3. STRUCTURE AND PROCEDURE FOR FORMING THE EXPERT BOARD

3.1. The issues of the formation of the Expert Council, early termination of the powers of the Expert Council or early termination, as well as the election of its individual members belong to the exclusive competence of the General Meeting of the Union members.
The exclusive competence of the Council of the Union includes:
- approval of the Regulation on the Expert Council, amendments and additions to this Regulation;
- approval (establishment) of additional requirements for the members of the Expert Council;
- submission to the General Meeting of the Union members of candidates for election to the membership of the Expert Council of the Union;
- suspension of the activities of the members of the Expert Council in the manner prescribed by the internal documents of the Union.
3.2. The Expert Council is formed from the members of the Union in a quantitative composition of at least 7 (seven) people.
3.3. The term of office of the members of the Expert Council is 5 (Five) years from the date of formation. Members of the Expert Council can be re-elected to the Expert Council an unlimited number of times.
3.4. Members of the Expert Council may be members of the Union who meet the requirements of the current legislation of the Russian Federation and additional requirements of the Union for members of the Expert Council.
3.5. The Expert Council is headed by the Chairman of the Expert Council.
3.6. The Chairman of the Expert Council and the Deputy Chairman of the Expert Council are approved by the Council of the Union from among the members of the Expert Council.
3.7. The Chairman of the Expert Council appoints the Secretary of the Expert Council from among the members of the Expert Council.
3.8. Revealing the fact of non-compliance of a member of the Expert Council with the requirements of the Law on Valuation Activity, these Regulations, is the basis for the application of a disciplinary measure in the manner prescribed by the Law on Valuation Activity, acts of the authorized federal body exercising the functions of normative legal regulation of valuation activity, other regulatory legal acts of the Russian Federation. 4. PRESIDIUM OF THE EXPERT BOARD

4.1. The Presidium of the Expert Council (hereinafter - the Presidium) is a collegial working body of the Expert Council.
4.2. The competence of the Presidium includes:
- development and submission to the Council of the Union of draft documents on the activities of the Expert Council;
- making a decision to conduct an unscheduled inspection of a member of the Expert Council who does not meet the requirements of the Law on Valuation Activities, this Regulation, in the manner prescribed by the current legislation of the Russian Federation, regulatory legal acts of the Russian Federation, internal documents of the Union;
- temporary suspension of the members of the Expert Council from the examination of the assessment reports in case of violations in their activities;
- consideration of appeals to expert opinions signed by members of the Expert Council;
- other issues stipulated by the legislation of the Russian Federation, Federal Valuation Standards, other regulatory legal acts of the Russian Federation, as well as internal documents of the Union.
4.3. The Presidium is formed by the Council of the Union from among the members of the Expert Council for a period equal to the term of office of the Expert Council. The number of members of the Presidium of the Expert Council is determined by the Council of the Union.
4.4. The Presidium is headed by the Chairman of the Expert Council. The Chairperson conducts meetings of the Presidium, and in case of his absence, meetings of the Presidium are chaired by the Deputy Chairperson of the Expert Council.
4.5. The Presidium of the Expert Council meets as needed.
4.6. Only members of the Presidium, the secretary of the Expert Council and persons invited by the Chairman of the Expert Council participate in the meetings of the Presidium of the Expert Council.
4.7. A member of the Presidium of the Expert Council may participate in a meeting of the Presidium personally or through his representative. The representative must be a member of the Presidium of the Expert Council, and his right to represent his interests must be confirmed by a notarized power of attorney.
4.8. A meeting of the Presidium of the Expert Council is competent if attended by more than half of the members of the Presidium.
4.9. Decisions of the Presidium of the Expert Council are made by a simple majority of votes of the members of the Presidium present at the meeting.

5. MEETINGS OF THE EXPERT COUNCIL

5.1. Meetings of the Expert Council are held as necessary, on the initiative of the Chairman of the Expert Council or the governing bodies of the Union.
5.2. Members of the Expert Council, as well as consultants and other persons involved in its work, take part in the meetings of the Expert Council.
5.3. A member of the Expert Council can participate in a meeting of the Expert Council personally or through his representative. A representative must be a member of the Expert Council, and his right to represent interests must be confirmed by a notarized power of attorney.
5.4. The decisions of the Expert Council are made by a simple majority of votes of the members of the Expert Council present at the meeting.

6. RIGHTS, OBLIGATIONS AND RESPONSIBILITIES OF THE MEMBERS OF THE EXPERT BOARD

6.1. The members of the Expert Council, if they are involved as experts for the examination of the assessment reports, are obliged to conduct such an examination or to motivate the refusal to conduct it.
6.2. Members of the Expert Council are required to:
- comply with the requirements of the legislation in the field of valuation activities, the Procedure for the examination of reports on the assessment of the Union, these Regulations and other internal documents of the Union;
- take part in the activities of the Expert Council, including meetings of the Expert Council;
- carry out the instructions of the Chairman of the Expert Council and his Deputy within the framework of their powers, including to carry out an examination of the assessment reports, as well as provide the members of the Union and other persons with explanations on issues related to the examination of the assessment reports;
- give evidence in court on the examination made on the basis of a court ruling;
- refuse to conduct an examination of the assessment report in the event of the occurrence (including at the stage of the examination) of circumstances that impede the conduct of an objective examination of the assessment report, as well as in case of insufficient professional qualifications;
- ensure the safety of documents received from the customer of the examination of the assessment report and third parties during the examination, in accordance with the Procedure for the examination of assessment reports of the Union;
- conduct a full study of the materials provided, give an objective and reasonable expert opinion on the issues raised;
- indicate in the expert opinion the justification for the conclusion based on the results of the examination of the assessment report, confirming the conclusion;
- provide clarification on issues related to the examination, and on the expert opinion;
- notify the executive bodies of the Union about the facts of influencing him by any persons in order to influence the conclusion (conclusions) contained (contained) in the expert opinion;
- to observe the confidentiality of the information that became known to him in connection with the examination of the assessment report, with the exception of cases provided for by the legislation of the Russian Federation;
- comply with other requirements stipulated by the current legislation of the Russian Federation.
6.3. Members of the Expert Council have the right:
- get acquainted with the materials related to the subject of examination, write out the necessary information from them or make copies;
- request from the customer of the examination and third parties the information necessary for the examination of the evaluation report;
- notify the appraiser before the transfer of the expert opinion to the customer about the results of the examination of the appraisal report signed by him, if this does not contradict the terms of the examination agreement;
- declare the need to involve other experts in the examination;
- to appeal in the manner prescribed by the legislation of the Russian Federation, actions that violate the rights of a member of the Expert Council;
- to carry out other actions provided for by the legislation of the Russian Federation, Federal Valuation Standards, other regulatory legal acts of the Russian Federation and the internal documents of the Association.
6.4. Members of the Expert Council are not entitled to:
- carry out the examination of assessment reports if the activity as an expert is suspended by decision of the Council of the Union in the manner established by the current legislation of the Russian Federation, regulatory legal acts of the Russian Federation, internal documents of the Union;
- enter into personal contacts with persons interested in the results of the examination on issues related to the examination, casting doubt on his disinterest in its results;
- use the information that became known in the course of the examination of the assessment reports for personal purposes;
- perform other actions, the ban on the implementation of which is provided for by the legislation of the Russian Federation in the field of valuation activities and internal documents of the Union.
6.5. The actions (inaction) of the expert or experts of the Union during the examination of the report, as well as the results of the examination, can be appealed by interested persons in the Union in the manner and within the time limits established by the authorized federal body exercising the functions of normative legal regulation of valuation activity, or challenged in court ...
6.6. Impact on the expert of the Union by the body or person on whose initiative the examination is conducted, the evaluators who participated in the preparation of the evaluation report, judges, as well as any bodies, organizations, associations and other persons interested in the outcome of the examination are not allowed.
6.7. The Union, having compensated for losses incurred by the customer who concluded the contract for the assessment, or property damage caused to third parties by the actions (inaction) of the appraiser or appraisers as a result of the violation of the requirements of the Federal Valuation Standards, standards and of the Union's appraisal activity rules, in the event of a positive expert opinion prepared and approved in accordance with the procedure established by internal documents, has the right of recourse to the expert (experts) who signed (signed) the said expert opinion.

7. PROCEDURE FOR AMENDING THE PROVISION ON THE EXPERT COUNCIL

7.1. Changes to these Regulations are made in accordance with the current legislation of the Russian Federation and internal documents of the Union.

8. FINAL PROVISIONS

8.1. Issues not regulated by these Regulations are resolved in the manner prescribed by the legislation of the Russian Federation and internal documents of the Union.

The indicated tariffs and terms of the examination of the assessment reports are minimal and increase depending on the complexity of the examination (composition, quantitative and qualitative characteristics and complexity of the subject of assessment, the total amount of work, etc.).

For neighboring real estate and land plots, a reduction factor of 0.33 is applied to the second and next assessment objects relative to the regional tariff. In this case, the object with the maximum area is taken as the base plot.
- When examining a revised version of the assessment report, the appearance of which is due to a change in the assessment date, a reduction factor of 0.7 from the regional tariff is applied.

Entry into the SRO is possible in 2 days. The list of documents required for entry is indicated on the website (list of documents, application, application form, consent to the processing of personal data).

Contribution to the compensation fund is 30,000 rubles.

The entrance fee is 0 rubles.

Quarterly membership fee - 0 rubles for:

Persons joining in 2016 who no more than 3 months before joining the NP “SROO ES” voluntarily terminated their membership in another self-regulatory organization of appraisers (the privilege is granted for 4 quarters, including the quarter in which the entry is made);

Persons entering in 2016 and having received a document on education in the field of assessment activities in a partner institution during the validity period of the agreement between the institution and the Partnership (the privilege is provided for 4 quarters, including the quarter in which entry takes place).

The following categories of Partnership members who do not carry out appraisal activities: (state and municipal employees; persons whose main place of work is legal entities that do not enter into assessment contracts as executors, including: banks, insurance companies, educational institutions; persons who are on maternity leave or maternity leave; disabled persons (more than 3 months).

Preferential 50% quarterly membership fee (1,000 rubles) for those who enter after November 12, 2015 and receive a document on education in the field of valuation activities no earlier than one year before the date of entry into NP “SROO ES” (the discount is granted for 4 quarter, including the quarter in which the entry is made).

For managers of appraisal companies and appraisers with more than 5 years of experience - individual conditions.

For all others, the quarterly membership fee is 2000 rubles.

For appraisers transferring to the Partnership from other SROOs and having a certificate in the direction / directions of appraisal activities of another SROO, a simplified certification procedure is provided in NP SROO ES.

From November 01, 2013 civil liability of each member of the Partnership is insured for 300,000 rubles at the expense of the Partnership. Please note that in order to join the Partnership, insurance must be issued by a member of the Partnership on their own (insurance is required for entry, the Partnership cannot arrange insurance for those who are not yet members of the Partnership).
