    State and folk holidays in Russia, Ukraine and Belarus

In every country of the world, in our time, a special production calendar is being developed without fail. At the same time, the data contained in it are approved by governments. It is this document that regulates their workers, it depends on where this or that person works, what his profession and

Why do you need a production calendar

This document is really necessary and important. Without it, the work of various kinds of financiers and accountants is simply impossible. It is the production calendar that helps them to predict and systematize the budget allocated for wages to employees of an enterprise. Of course, the information contained in this document will be useful to the employees themselves. The calendar takes into account absolutely all weekends and holidays. Such information will help you plan your personal time.

How this document is compiled

Thus, the production calendar is the most reliable and accurate source containing information on such an issue as holidays, weekends and working days of the year. How many there will be depends not only on the place of work of a person. In each particular year, a different number of them can turn out. This is primarily due to the fact that they often fall on weekends. The difference is small, but still there. For example, in 2012 we worked 250 days, and in 2013 - 247. The number is also affected by whether it is a leap year or a regular one. Thus, the calendar allows the employee to always be informed about all non-working holidays. This useful document annually. Only the Government of the Russian Federation has the right to make changes to it. Therefore, it is worth not only familiarizing yourself with the calendar, but also following the relevant decrees.

What laws govern calendaring

How many working days will be reflected in this document and how many holidays - information that is directly dependent on the standards specified in Labor Code RF. So, according to article 112 (part 2), if a holiday coincides with a weekend, the latter is transferred to the working day (first) after the holiday. That is, for example, if March 8 falls on a Sunday, the rest is on Monday. In addition, according to the same article preceding the holiday for one hour.

According to the changes made to the said article of the code on 23/04/12, the government is given the right to postpone two days off new year holidays for any working days in the year (current). For example, such a decision was made in 2013. The January weekend added non-working days to

There is also part five of article 112, according to which the weekend can be postponed by the Government of the Russian Federation (special resolution). Such a law allows employees in certain situations to use their personal time much more rationally.

For example, if the holidays fall on Sunday and Monday, the day off can be moved not to Tuesday, but to Friday.

Also, when compiling the production calendar, article 110 of the Labor Code of the Russian Federation is taken into account, according to which the number of hours of rest (continuous) should not be less than 42.

Calendar for 2014

The number of working days in a year, as the reader has already understood, is directly dependent on the Government of the Russian Federation, which compiles the production calendar. What did it please us in 2014? So, according to this document, the holidays, and therefore non-working days this year will be the following:

  • January 1 - 6 and 8 - New Year;
  • 7/01 - Christmas;
  • 23/02 - Defender of the Fatherland Day;
  • 8/03 - March 8;
  • 1/05 - Spring Festival;
  • 9/05 - Victory Day over Nazi Germany;
  • 12/06 - Day of Russia;
  • 4/11 - Unity Day.

Thus, this year we rested 8 days for the New Year. On March 8, there will be 3 non-working days (from 8 to 10). In May, we rest 4 days (1 - 4) for the Spring Festival and for Victory Day - 3 days (9 - 11). And four more free days await us in November (from 1 to 4). If you make simple calculations, it turns out that the number of working days this year will be 247, as in 2013. Reduced by one hour - 6. There will be 118 non-working days, including all weekends. Of course, all these calculations correspond to a working five-day period.

Working hours

Of course, it is worth knowing not only how many holidays are due to employees in each particular year, but also about how many hours he can work in a certain period of time (maximum). Such issues are regulated by Article 91 of the Labor Code of the Russian Federation. For example, the number of working hours per week cannot exceed forty. At the same time, each employer (regardless of legal form enterprises) must necessarily take into account the actual time worked by each employee.

Who is entitled to a reduced number of hours

Working days of the week may be reduced for certain citizens. Of course, everyone should also know about this.

  1. For workers under 16 years of age, the number of hours worked per week must be reduced by 10.
  2. Over 16, but under 18 - by 4 hours.
  3. Disabled workers will have to work 5 hours less.
  4. In the areas of production with harmful conditions labor work week must be reduced by 4 hours (or more).
  5. For employees of chemical industries listed in the law, a 36-24-hour week may be established.
  6. Pregnant women will also have to work less time

Thus, no one should work more than 40 hours, regardless of whether the five-day or six-day week is provided for in the enterprise.

Five and six day week

The duration of each working day is determined primarily internal regulations specific company. Of course, the law also regulates this issue. According to the regulations, working days in Russia are five days from Monday to Friday inclusive. However, this condition is not considered mandatory for execution in all cases. According to the law, the employer, based on the characteristics of production, can also establish a six-day week. Thus, in some enterprises, employees work extra on Saturday or Sunday. However, the statutory maximum number of hours per week is respected in any case.

What counts as working time

Of course, the law also regulates this issue. Working hours - the hours during which an employee, in accordance with employment contract performs his duties. This regime is one of the essential conditions of this document, which can only be drawn up taking into account the norms of the Labor Code of the Russian Federation. Based on this, you can determine all the working days in the year. How many there will be depends, therefore, on the terms of the employment contract, the norms of the Labor Code of the Russian Federation and government decrees.

A number of other points are also legally counted during working hours.

  • Breaks spent on heating in cold weather (for those who work outdoors).
  • Downtime hours.
  • For women with babies, the time spent on feeding.
  • Breaks for meals (in the event that a person cannot leave his

Thus, we answered the main question of the article: "Working days in a year - how many are there, and how to determine this?" In 2014 there will be 247 of them. No one should work more than 40 hours a week, regardless of whether it is a five-day or six-day period, and working time is a concept regulated by an employment contract drawn up taking into account the Labor Code of the Russian Federation. With regard to holidays, the Government can transfer the days off that coincide with them to any day of the year at its discretion.

Everyone who works in an official enterprise should be aware of the exact number of working days for any period of time. This will help to correctly calculate your days off and not fall for the bait of negligent bosses who want to make money on you. You will learn about all this and even more by reading the article.

Also in Soviet times The human work week consisted of six days. Accordingly, the vacation was calculated taking into account the average monthly working days - 25.4. And working days were calculated as follows: all holidays and Sundays were subtracted from 365 days, and then this number was divided by 12. But there were also leap years. For the accuracy of calculations, these years were also taken into account and calculated average for several years.

To date, the law establishes a working week lasting five days and no more than 40 working hours per week. calendar days equals 29.3. From this, you can calculate the average annual number of calendar days:

the average number of working days in a month is multiplied by the number of months (29.3 * 12 = 361.6).

This number should be taken into account when calculating vacation pay and.

Average number of working days per month for calculating vacation pay

We bring to your attention the current calculation of vacation pay:

Amount of vacation pay \u003d Average earnings per day * Number of vacation days

The amount of vacation pay also depends on the increase or decrease in the rate.

Vacation days are usually counted by calendar days. In total, the employee is credited with 28 days. Moreover, the employee does not have to leave immediately for the entire period, but can take him off in parts during the year.

Employees who have not reached the age of majority must have 31 days of leave, and people with disabilities 30 days.

Example and procedure for calculating vacation pay

- this is essentially the same salary, only they consider it for the time when you do not go to work.

According to Article 74 of the Labor Code, workers have at their disposal paid leave every year. It is given with the preservation of salary and position. During the vacation you are required to accrue vacation pay, their size is approximately equal to the salary for the same time. They are easy to calculate. Even for a person who knows nothing about accounting, there is a completely simple formula: vacation pay = the amount of payments for the reporting period is divided by the number of days, and multiplied by the number of days of the vacation period.

That is, the amount of vacation pay depends on the average daily earnings during the previous period. To do this, you need to calculate the total size for the working year, and then divide it by the number of days. For this purpose, non-working days are subtracted from the number of calendar days for a certain period. This is how we calculate the average daily wage. To find out the amount of vacation pay, we multiply the resulting number by the number of days in the calendar for the vacation period.

Examples of solving problems for calculating the amount of vacation pay

Task #1

Given: The employee was accepted on 02/02/2015. For the period from April 2015 to March 2016, he received 182,430 rubles. From 04/17/2016, he takes the prescribed main leave lasting 28 calendar days. That is, his vacation will last from April 17 to May 16, 2016 inclusive.

Q: How much vacation pay?

Explanation: The attentive reader will notice that it turns out 30 days. That's right, it's just that May 1 and 9 are days off, and May 1, 2016 fell on Sunday, which is why the day off was moved to Monday. And those 2 extra days off added to the vacation. But this fact does not affect the payment. If the main vacation is given for 28 days, then 28 days are paid, regardless of the extra non-working days.

  1. 182430: 29.3:12 = 518.85 (rubles) - the amount of average daily payments
  2. 518.85 x 28 = 14528 (rub.)

Answer: The employee will receive 14528 rubles. for 28 days of vacation.

Task #2

Given: 08/03/2014 the employee started working. From May 25, 2015, he was given a duration of 24 days. During the working period, he earned 84,000 rubles.

Q: How much vacation pay will an employee receive?

Explanation: The settlement period is considered from August 2014 to April 2015, that is, an incomplete year - 9 months. August is included as a full month, despite the fact that the employee was hired on the 3rd - since August 1 and 2 turned out to be days off.

  1. 273 - 5 = 268 (calendar days)
  2. 84000: 268 = 313.43 (rubles) average daily salary
  3. 313.43 x 24 \u003d 7522.39 (rubles) vacation pay

Answer: The employee will receive 7522.39 rubles. in 24 days.

Task #3

Given: Employee leaves for 28 days due leave from 06/16/2016. Before that, she spent 3 years in. The salary of the employee, according to the position and relevance on the day of going on vacation, is 15350 rubles.

Question: What will be the amount of paid vacation pay?

Explanation: Since she did not receive any payments for the previous calendar year through no fault of her own, tariff scale, or official salary, the size of which is relevant on the day of going on vacation.

  1. 15350 x 12 \u003d 184200 (rubles) the amount of estimated payments for 12 months
  2. 184200: 29.3:12 = 523.90 (rubles) hypothetical average daily earnings
  3. 523.90 x 28 = 14668 (rub.)

Answer: The employee will receive 14668 rubles. holiday pay.

Weekends and holidays in 2018, approved by the Government

In accordance with Part 1 of Art. 112 of the Labor Code of the Russian Federation, non-working holidays in the Russian Federation are:

  • January 1, 2, 3, 4, 5, 6 and 8 - New Year holidays;
  • January 7 - Christmas;
  • February 23 - Defender of the Fatherland Day;
  • March 8 - International Women's Day;
  • May 1 - Spring and Labor Day;
  • May 9 - Victory Day;
  • June 12 - Day of Russia;
  • November 4 is National Unity Day.

According to the second part of Part 1 of Art. 112 of the Labor Code of the Russian Federation, if a day off and a non-working holiday coincide, the day off is transferred to the next working day after the holiday, with the exception of days off coinciding with non-working holidays from January 1 to January 8.

In 2018, a non-working holiday on November 4 coincides with a day off (Sunday). Therefore, this day off is transferred to the next working day after the holiday: on Monday, November 5th. Days off (January 6 and 7) coinciding with non-working holidays from January 1 to 8 are not automatically transferred to the next working day after the holiday. The Russian government can only postpone two such days off.

In order to rationally use weekends and non-working holidays by employees, days off can be transferred to other days federal law or a regulatory legal act of the Government of the Russian Federation (part 5 of article 112 of the Labor Code of the Russian Federation). Decree of the Government of the Russian Federation of October 14, 2017 No. 1250 "On the postponement of holidays in 2018" provides for the postponement of holidays:

  • from Saturday 6 January to Friday 9 March;
  • from Sunday 7 January to Wednesday 2 May;
  • from Saturday 28 April to Monday 30 April;
  • from Saturday 9 June to Monday 11 June;
  • from Saturday 29 December to Monday 31 December.

It should be noted that the duration of work on Saturdays April 28, June 9 and December 29 is reduced by one hour, since, according to paragraph 1 of the Procedure, in cases where, in accordance with the decision of the Government of the Russian Federation, a day off is transferred to a working day, the duration of work on this day ( former day off) must correspond to the length of the working day on which the day off is transferred.

The pre-holiday days in 2018 are February 22, March 7, April 28, May 8, June 9 and December 29 (the duration of work on these days should be reduced by 1 hour).
