However, most of these grounds are absolutely not suitable for ordinary citizens.

1. Lease of a land plot for individual housing construction, personal subsidiary plots, gardening, summer cottages, and for peasant farms.

This ground is contained in subparagraph 15 of part 2 of article 39.6 of the Labor Code of the Russian Federation.

If you follow the materials on the blog, you probably noticed that in the article we have already considered obtaining land for individual housing construction, personal subsidiary farm, gardening, dacha farming and peasant farms.

For reference.

Since January 01, 2019, the dacha economy has been excluded from the legislation. Country plots are equated to garden plots.

For this reason, any mention in the article about summer cottages should be replaced with garden plots.

However, in that article it was about how to buy a land plot without bidding, that is, to acquire land as a property.

Now let's consider the same thing, but only for land lease.

For what purposes can the land be rented?

  • land lease is possible for the construction of an individual residential building (IZHS).

It will not be possible to rent land plots for a hotel, a car repair shop, a store and other objects without bidding on this basis.

If you want to get land to build a house or cottage, then this method is for you.

Useful advice: Many people, looking for land for the construction of an individual house, they want to get the land in the property.

This is because, in their opinion, ownership is more secure than rent.

However, this is an illusion that draws extra money from the purse of the deluded.

You need to understand that the state can withdraw almost any plot for its needs, even the one that you own by right of ownership.

Therefore, ownership of the land is not a 100% guarantee against the withdrawal of the site.

At the same time, the purchase of an empty plot of land (that is, the acquisition of ownership) for individual housing construction is most often more expensive than renting the same plot and then buying out the land under an already built house.

In other words, in most cases it is much more profitable not to immediately buy a land plot for individual housing construction, but to rent it, build a house, and only after that buy out a plot under completed construction.

In such a case, the buyout value will usually be significantly lower than the purchase price of an empty lot.

What is 1 (one) important difference between land plots for private household plots and plots for individual housing construction?

Plots for individual housing construction can only be located within the boundaries of a settlement.

You will not find a site with a type of permitted use under IZHS outside the city, town or other settlement.

But plots intended for private household plots can be located both inside the settlement and outside it.

However, only those plots that are located on the territory of the settlement can be rented for private household plots without bidding.

If the site has the type of permitted use - private household plots, but is located outside the settlement, then it will not work to rent such a site without bidding on this basis.

However, it is possible to rent land for private household plots that is located outside the boundaries of the settlement on a different basis.

  • lease of land for gardening and dacha farming.

Plots for dacha farming are more attractive than plots for gardening.

This is explained by the fact that on the land under the cottage you can register, before that you have built a house.

  • lease of land for carrying out activities by a peasant (farm) economy.

Beginning farmers who did not get land shares, as a rule, rent land without bidding. And very often, they do it very successfully.

Who can lease land without bidding?

Only a citizen or a peasant (farm) enterprise can receive a land plot for rent without bidding.

At the same time, the purpose of using the land should be: individual housing construction, private household plots within the boundaries of the city (village), gardening, summer cottages or peasant farms.

Legal entities (organizations) do not have the right to lease land for these purposes without bidding.

How to rent land without bidding?

In order to start the procedure for obtaining land for rent, one of the following applications must be submitted:

  • on preliminary approval of the provision of a land plot,
  • application for the grant of land.

An application for preliminary approval is submitted for a land plot that has not yet been formed.

In other words, such a plot does not yet have a cadastral number.

For example, you found a free land plot that is not formed, that is, it has no boundaries.

After that, you can in 40 minutes independently and submit it together with an application for preliminary approval.

administration during 30 days should give one of 2 possible answers:

  • agree on the provision of land for lease.

In this case, you get the right to rent this site from the administration without bidding.

  • refuse your pre-approval.

In this case, you can find a new site and submit another application.

Or you should write a complaint to the prosecutor's office or the court, because officials often "sculpt" illegal refusals.

An application for the provision of a plot is submitted in relation to the land that is put on the cadastral register.

Such an application is submitted if the land plot has boundaries and a cadastral number.

For example, on a public cadastral map, you found a free plot that is not leased.

There are many such lands in the country.

To rent this plot without bidding, you need to submit an application to the local administration for the provision of a land plot.

After 30 days, the result should be:

  • or you will receive a plot for rent without bidding,
  • or the administration must give a reasoned refusal that can be challenged.

2. Lease of a plot of land under the object of construction in progress.

I sometimes receive questions in the comments - is it possible to buy the land on which only the foundation of the house stands, or the walls have been erected, but the house has not been put into operation.

The answer to this question is negative.

It will not work to buy out the land plot on which the “incomplete” is located without bidding.

However, such a piece of land can be rented.

The owner of an unfinished construction object can once lease a land plot without bidding in order to complete the construction.

You will find this basis in subparagraph 10 of part 2 of article 39.6 of the Labor Code of the Russian Federation.

3. Lease of land by citizens entitled to priority and extraordinary receipt of land plots.

Preferential land acquisition is an interesting way for many people to rent land.

However, it also very often causes disappointment.

Cases when preferential categories of citizens, that is, those people who have the right to receive a land plot in priority and extraordinary, are established by federal and regional laws.

As of January 2017, I found only one law that allows beneficiaries to rent a land plot without bidding.

This is the law of St. Petersburg dated July 18, 2016 N 443-84 "On some issues of providing land plots for rent without bidding."

By this law citizens of the Russian Federation who live in St. Petersburg and are:

  • disabled people of I and II groups,
  • children with disabilities who have limited mobility and medical indications for providing technical means rehabilitation of disabled people in the form of wheelchairs in an individual rehabilitation (habilitation) program for a disabled person (disabled child),

have the right to priority lease for storage of personal vehicles (without the right to erect real estate objects) of land plots.

As you can see, you cannot build a house on a land leased under this law.

4. Lease land in cases where it is impossible to transfer the land to ownership.

5. Renting a plot for haymaking, grazing, gardening and personal subsidiary farming.

Only a citizen can rent a land plot on this basis.

Organizations and peasant farms cannot lease a plot on this basis.

An exact description of this basis for renting a plot without bidding is contained in subparagraph 19 of part 2 of article 39.6 of the RF LC.

Land can only be rented for 4 types of purposes:

  • haymaking,
  • grazing farm animals,
  • under the garden
  • maintaining private household plots on a land plot located outside the boundaries of the settlement.

Sometimes officials refuse to rent a plot for a garden, due to the fact that the land is located within the boundaries of the settlement, and not outside it.

Such a refusal to lease a plot is illegal, because the condition for the location of the plot outside the settlement applies only to private household plots.

It is possible to rent a land plot without bidding for haymaking, grazing of agricultural animals and for a garden, regardless of whether the plot is located outside the settlement or within it.

A similar official refusal took place in the city of Cheboksary.

But Supreme Court Chuvash Republic by his decision of March 16, 2016 in case N 33-1070/2016, he put the officials in their place.

6. Lease of 1 hectare of land in the Far East.

As you know, from February 1, 2017, all Russians will have the opportunity to purchase 1 hectare of land on Far East for free use for a period of 5 years.

In the office of Mr. Yu.P. Trutnev expects in February a surge in applications for a Far Eastern hectare from residents of the western regions of Russia. Wait and see.

But the question is:

What to do with the Far Eastern hectare after 5 years of gratuitous use?

If you do not abandon the Far Eastern hectare and do not transfer it into ownership, then all that remains is to rent it.

You can rent a Far Eastern hectare for up to 49 years.

By the way, if a plot was taken for free use from the lands of the forest fund, then after 5 years of free use such a plot can only be rented.

It will not be given away.

At least for today, the legislation on the Far Eastern hectare does not allow to receive forest plots in the property.

How to rent the land of the Far Eastern hectare?

You need to apply for a land lease.

With the Far Eastern hectare, it is important not to "miss" the deadlines, because the application can be submitted no earlier than 6 months before the expiration of the contract for the gratuitous use of a hectare.

In other words, after 4.5 years of gratuitous use of the Far Eastern hectare have passed, you need to apply to transfer the land for rent for up to 49 years.

It is important to have time to submit this application before the expiration of the 5-year period of gratuitous use.

Simply put, you will have 6 months to decide whether to rent the land or also generously return it to the state.

7. Lease of land for hunting.

Only legal entities or individual entrepreneurs can lease land for hunting.

An ordinary citizen cannot rent a plot for hunting, because hunting agreements are concluded only with organizations and individual entrepreneurs.

If entity or individual entrepreneurs, as a result of the auction, have concluded a hunting agreement, then they can lease land and forest plots.

The lease term for a land plot ranges from 20 to 49 years.

In subparagraph 24 of part 2 2 of article 39.6 of the Land Code of the Russian Federation you will find an exact description of this basis for obtaining land for rent.

8. Lease of land for buildings and structures.

Owners of houses, buildings, structures and premises have the exclusive right to lease the land on which these real estate objects are located.

Some organizations may own buildings and any other property only on the basis of the right of economic management or operational management.

Such organizations can also rent land for their buildings without bidding.

In the summer, the townspeople are irresistibly drawn to "dig in the ground", but not everyone has the cherished six acres ... Thus, the idea was born to create a "Public Garden" in the city. And in Moscow there were many hunters to the beds.

What did the Muscovites begin to grow? To find out, the RG correspondent went to Nizhny Susalny Lane, where a public garden is open. A long underground passage behind the metro station "Kurskaya" led to the former factory buildings. Then the guard at the checkpoint demanded to show the passport: the territory is protected. Inside, you can see the gates painted with flowers, and behind them, next to the green grove, stretched out the desired beds. There is a greenhouse in which tomatoes are grown and seedlings are stored. Nearby hangs a rustic washstand with poured water.

The size of the field of activity offered to the Muscovite is a plot of 200 by 70 centimeters with black soil ready for planting. Such projects, as one of the organizers of the unusual garden, Vasily Palshen, said, are not new in large cities abroad, and they are very popular there. So Moscow has already gone the beaten path.

Many "tenants" have never dealt with the land at all, so we organize all sorts of interesting lectures for them with practical support: how and what to plant, how to care. Moreover, we will talk not only about the usual garden crops, but also about artichokes that are rare for our strip, for example. There are no restrictions on growing plants, with the exception of prohibited ones (marijuana, purple poppy). But for now lettuce, parsley, and rhubarb come out in neat rows on busy beds. The city authorities set up Pet Corners in three forest parks at once. One of them is in the Bitsevsky forest park, to which the mayor of the capital gave a pair of goats and sheep each. The aviary with livestock is located next to the household yard, not far from the entrance from the side of the Novoyasenevsky dead end.

Last fall, there was an addition to animal families. Although they live behind a grid, both children and adults are allowed to visit them. Goats and sheep fully acclimatized, they survived the winter in a house specially built for them. For goats, special floorings are made here at a height of half a meter - unlike sheep, they do not sleep on the floor, although it is not naked - it is covered with hay and straw.

Both goats and sheep are thoroughbred, - says Tatyana Luneva, deputy general director of the Bitsevsky Forest natural park. - The older lambs are one and a half years old, this is the Altai fine-wool breed, wonderful knitted things are obtained from their wool. And the goats - the Russian white breed - are beautiful and fluffy. They are six months to two years old. It is better to come to us before five o'clock in the evening, because later the security yard is closed by guards. After all, animals wake up early.

As Luneva explains, first of all, this "living corner" is designed for children who can pet, feed the animal, and if you're lucky, then milk it ... In addition to artiodactyls, there are cages with pheasants and chickens.

In addition, such know-how in the city will bring fame as innovators and the image of caring owners of the local administration, and it's in the bag.

It will be about organizing an ordinary garden, but within the city limits. You will say that there is no production in the city necessary conditions, they say, there are a lot of plants and factories that do not contribute to the creation of environmentally friendly products? But after all, it is absolutely not necessary to set up a garden near the walls of those same factories and factories, it is quite possible to choose a corner in a green park area for this, just arrange everything so that it looks presentable.

I propose to set aside a small area for a vegetable garden where city dwellers could produce their own vegetables and fruits. The fact is that many are interested in this type of work, which brings pleasure and serves as a free gym, and is a good addition to the main income, which clearly does not hurt family budget. Such a garden is especially useful for pensioners who have a lot of free time, where they can increase their income for retirement and communicate with peers.

I have already said that the main thing is to be interested in this idea. local authorities, then there will be no problems with the land (in the green zone anyway, you can’t build houses or offices) and people will benefit.
