Who, to whom and how will issue permits for obtaining a passport? Will the Ministry of Emergency Situations encryptors and generally all servicemen of the rescue department be able to travel abroad? Under what conditions and who will sign their permits?

The answers to these questions are contained in the order of the head of the Ministry of Emergency Situations No. 360 dated June 4 this year, signed by Vladimir Puchkov and published today in RG.

This document is registered with the Ministry of Justice and from now on will determine the order of, for example, where the employees of the Ministry of Emergency Situations will be able to spend their vacation - on the beaches of Montenegro or Turkey, or with a fishing rod on the shore of Lake Baikal, or in the sanatoriums of Anapa.

In addition, now the Russian Emergencies Ministry is actively developing ties and strengthening cooperation around the world. Treaties and even entire bases are now emerging in Europe. In particular, in the Serbian Nis, the Ministry of Emergency Situations will soon have a full-fledged center. EMERCOM employees will soon be traveling abroad much more intensively than before.

In addition, the forecasts of climatologists are not reassuring. Russian rescuers are already flying around the world, rescuing people from trouble and extinguishing fires on all continents.

At the same time, the level of secrecy in the department is not much different from, say, the Ministry of Defense. And in this sense, the order, of course, affects tens of thousands of people, in fact, the entire personnel of the ministry.

Here we must immediately make a reservation that we are not talking about a completely new order. The order of the minister only amends the earlier order No. 345 of 2005, which was entirely devoted to the issue of obtaining foreign passports and the departure of employees of the ministry abroad. That order was approved detailed instructions according to the rules of registration of travel documents and permits to travel. It has not lost its relevance and corresponds to the level of secrecy in some units of the Russian rescue department.

Now, according to Irina Rossius, the official representative of the Russian Emergencies Ministry, "the new order of the Russian Emergencies Ministry simplifies the procedure for obtaining passports and issuing permits to leave Russian Federation military rescue military formations EMERCOM of Russia, servicemen and employees of the State Fire Service and civilian personnel of the system of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters, eliminating unnecessary administrative barriers arising from the conduct of official correspondence and decision-making by managers on this issue. "

The simplifications mainly concern approvals and permits. That is, the procedure for obtaining permits for issuing passports will become less bureaucratic, simpler and more transparent. Accordingly, the period from the time of filing an application to obtaining a permit will be shortened.

By the way, the amendments largely concern employees with security clearance. And the amendments, on the one hand, simplifying the procedure for issuing exit permits, do not automatically guarantee it.

Restrictions on travel have been and remain. The reasons for the restrictions are not listed in the order. The order only states that all reports and statements will be sent to the Department of Information Protection and Safety of Rescue Operations of the Russian Emergencies Ministry. This department will have to prepare a draft decision on the temporary restriction of travel for a certain category of employees or the possibility of issuing a passport.

Not all Russians have the opportunity to visit other countries. The travel abroad of civil servants, military personnel and employees of various law enforcement agencies is limited by the legislation of our country. Some of these prohibitions are enshrined at the legislative level, although some of them are advisory in nature.

To whom the exit is closed

The regulations for the travel abroad of employees of the Ministry of Internal Affairs and other structures are displayed in. According to it, the following entities are restricted from the right to travel outside the country:

  • persons on duty using open access to materials of extreme importance or absolutely confidential information constituting a national secret;
  • persons mobilized for military or alternative service;
  • persons serving in institutions Federal Service security;
  • persons to whom anti-Russian sanctions have been applied foreign countries.

It is worth explaining that there is a ban on the departure of employees of the Ministry of Internal Affairs abroad, as well as a similar one concerning employees of the Ministry of Defense, and the FSB, and the Foreign Intelligence Service, and the Penitentiary Service, and the Ministry of Emergency Situations. In addition, it is also applicable to the staff of officials registered for the civilian government service, i.e., for example, the travel abroad of civilian personnel of the RF Ministry of Defense is also limited.

List of states

The emergence of the above list is associated primarily with the need for the state to protect information related to sovereign secrets, and in addition - the complication of relations in the modern political arena. For example, the countries themselves that have concluded extradition treaties with the United States of America and the powers that are members of the Alliance are subject to the most severe restrictions. But those who are friendly towards Russia are open to entry.

Where prohibited

There are more than 150 countries in the list of states that are strictly prohibited from visiting. In light of the constantly changing political situation, it is recommended to check the information on the website of the Russian Ministry of Foreign Affairs.

Where allowed

Which countries the servicemen can travel to is determined by the priority of their friendly attitude towards the Russian Federation. Unfortunately, the list of allowed countries for military personnel, officials and government employees is not very extensive. An alternative to rest abroad for these categories of people is the vast expanses of our homeland.

Rules for the military

The ban on the departure of military personnel abroad in 2019 is governed by the same, which means that it applies to:

  • persons mobilized for military or alternative service;
  • persons serving under the contract;
  • military personnel admitted to special (stamped) information.

The ban on leaving is documented, certified by the signature of a serviceman and is valid for 5-10 years from the time of the last study of confidential information. It is worth noting that the ban on traveling abroad for a conscript does not extend to his relatives.

If travel abroad is nevertheless necessary (for example, illness / death of one of the relatives living in another country), the soldier must obtain the official approval of the commander in accordance with the regulations. To do this, you will need, firstly, to provide a report addressed to the person in charge with a request to authorize a trip abroad and issue him a passport.

With the consent of the leadership, the soldier is issued a certificate authorizing the receipt of a document for crossing the border.

Secondly, submit an application and fill out a questionnaire for a foreign passport, add a certificate issued by the command to the documents. The duration of the ban on travel abroad at the end of service varies depending on the following circumstances:

  • if a soldier during the period of service was admitted to classified materials, then at the end of the service the period of restriction is extended to another 5-10 years;
  • if a citizen served under a contract, then the term of the ban on traveling abroad is regulated by the contract.

Servicemen whose service period has ended, provided they do not have access to stamped materials, are allowed to visit other countries without hindrance.

For law enforcement officers

At the moment, there is no strict ban on entry to other countries regarding the employees of the law enforcement agencies. However, the organization of a secrecy regime when traveling abroad imposes similar restrictions on security officials who have access to classified information.

However, back in 2015, at the initiative of the State Duma deputies, the Ministry of Internal Affairs advised its employees not to leave the country without exceptional need. If, nevertheless, there is an urgent need to travel abroad, the employees of the Ministry of Internal Affairs must also follow the above scheme. First of all, they are obliged to submit a report for traveling abroad to the responsible officer and only after receiving official permission to prepare documents for a trip abroad.

Can prosecutors travel abroad? Let us repeat that there is no law prohibiting employees of law enforcement agencies from traveling abroad (except for a ban for persons admitted to information of high secrecy). However, in the spring of 2019, the State Duma submitted for consideration the issue of imposing a temporary ban on travel abroad for police officers and persons occupying leadership positions at the Ministry of the Interior. If the new bill is approved, the employees of the Ministry of Internal Affairs will be forced to include a corresponding article in the contract.

In such conditions, the question of where the police officers can go to rest remains open for many. For the most part, it is customary to adhere to the recommendations given by the Ministry of Foreign Affairs to limit the number of countries that are allowed to travel.

Rosgvardia

Are Rosguard employees allowed to travel abroad? Restrictions on visiting foreign countries in relation to employees of the structure are identical to the requirements for military personnel in this matter:

  • travel to other countries is prohibited throughout the entire period of service;
  • at the end of the service, the employee remains restricted to travel abroad for 5-10 years, if during the period of service he was admitted to confidential information;
  • for contractors, the period of validity of the restricted travel ban is governed by the period stipulated by the terms of the contract.

If an employee during his military service did not work with classified information, then travel restrictions end simultaneously with the term of his service.


Can FSB officers travel abroad? Employees of this department are also subject to a number of travel restrictions until the termination of the contract. Employees of the service apparatus have the right to receive the approval of the head for a visit to another country only on the basis of one of the following reasons:

  • the need for specialized treatment;
  • illness / death of a relative living in another country;
  • settlement of hereditary issues;
  • settlement of proceedings for the confiscation of property registered abroad;
  • visiting relatives living in another country.

A request to leave is submitted 3 months before the planned event, if there are no urgent factors. The application shall be accompanied by acts, certificates, etc. justifying the need for crossing the border. Based on the results of the consideration of the documents, the management must make a decision.

Customs officers

As well as other government departments, the Federal customs service a letter was received from the Ministry of Foreign Affairs of the Russian Federation in a recommendatory form proposing to refrain from departing employees of the department to other countries. But locally, in structural units, such recommendations are accepted rather as an order for execution.

The order of the Ministry of Emergency Situations on leaving the border in 2018 No. 244 "On additional measures to increase social security, ensuring comfortable working conditions and service for the personnel of the EMERCOM of Russia" dated 06/07/2018 consolidates the prescribed recommendations of the Ministry of Foreign Affairs of the Russian Federation to restrict the rights of employees of this government body to travel abroad. The list of countries allowed for EMERCOM employees to travel is limited to those that are exclusively friendly towards Russia.

The procedure for obtaining permission to leave the Russian Federation

To authorize travel abroad for all servicemen, persons with access to classified information, as well as employees of the other departments discussed above, a certain procedure has been established.

  1. An employee planning to travel abroad is obliged to submit a report (application) addressed to the head of the FSO of Russia, where it is mandatory to indicate: the country planned for visiting; purpose of the trip; check-out date; source of funds for the trip; what kind of transport you are planning to use; travel agency details; information about the person who sent the invitation.
  2. The manager who has accepted the application certifies it and puts a time stamp and the level of the applicant's awareness of information constituting a state secret. Sends documents to the HR department.
  3. HR staff and operational management the application is marked with the presence / absence of reasons for the restriction of the right to leave.
  4. An exit permit is issued or denied.

One of the reasons for refusing to travel abroad is the presence of debts to the tax and utilities services, as well as unpaid fines and other debt obligations. ? This can be done in several ways.

  1. You can check for debts in taxes and fees on the website of the Federal Tax Service.
  2. You can check whether there is a debt set for execution by a court decision on the website of the bailiffs (FSSP).
  3. On the portal of public services, they check debts for unpaid fines.
  4. It is not difficult to check the presence of debt to the bank by contacting the credit bureau.

After payment of the existing debt, the information in the databases of government departments will be reflected only within 1-3 weeks, so do not postpone it until the last moment. You should prepare in advance for the trip, for this it is important to know.

  1. A valid passport.
  2. Visa, because visa-free entry for citizens of the Russian Federation is not allowed to all countries.
  3. Insurance policy.
  4. Round trip tickets
  5. A travel voucher if a person travels on a pre-purchased voucher.

Despite the fact that the list of documents for leaving the country is not so long, it should be borne in mind that additional requirements may be imposed on visiting certain countries. Consequently, the list of required securities can be expanded.

Which countries are on the list of allowed?

In total, there are 13 countries in the list that were selected by the Ministry of Internal Affairs based on the following factors:

  • the military-political situation;
  • criminogenic situation;
  • sanitary and epidemiological situation;
  • military-political situation.

Police officers are allowed to travel abroad in 2018 to the following countries:

  • Uzbekistan;
  • South Ossetia;
  • Armenia;
  • China;
  • Cuba;
  • Tajikistan;
  • Abkhazia;
  • Azerbaijan;
  • Turkmenistan;
  • Belarus;
  • Vietnam;
  • Kazakhstan;
  • Kyrgyzstan.

According to experts tourism business, a beach vacation from the above list is possible only in Cuba, China, Vietnam and Abkhazia. At the same time, rest in the first three countries is unlikely to be affordable for an ordinary police officer, since vouchers to such distant countries are sold at a price of 100,000 rubles.

In other countries, excursion and sanatorium-resort vacations are a priority, and some countries (Kazakhstan, Kyrgyzstan, South Ossetia and Tajikistan) are not represented at all in Russian. tourist market... Most likely, the employees of the Ministry of Internal Affairs were allowed to travel abroad in 2019 to these countries so that they could visit relatives who have been living there since the days of the USSR.

Tour operators were surprised by the inclusion of a state such as Turkmenistan in the list of countries for the rest of the police in 2019. Tours to this country are not carried out due to the strict visa regime. Most likely, as in the case of the previous "four", Turkmenistan is "open" for visiting local relatives. According to statistics, about 5% of the population of this country are Russians.

This order of the Ministry of Internal Affairs does not give the unconditional right to police officers to travel to these countries on vacation. In the text of the order there is a clause that this list must be guided by when considering reports on traveling abroad during the vacation period of employees of the Ministry of Internal Affairs, including civil servants. That is, the final decision will still be with the authorities, which in each specific case will decide whether it is possible for police officers to travel abroad in 2018, but the latest news from employees of the Ministry of Internal Affairs should be encouraging.

In previous years in jurisprudence there were many cases when the court confirmed the legality of the dismissal of a police officer for unauthorized travel abroad without obtaining the appropriate permission from the higher management. For example, Appellate ruling No. 33-4937 / 2015 03 November 2015, in which the Judicial Collegium for Civil Cases of the Khanty-Mansiysk autonomous region canceled the decision of the lower instance and recognized the dismissal of the OMVD interrogator for unauthorized travel abroad as justified.

The panel concluded that the police officer ignored job descriptions The Ministry of Internal Affairs of the Russian Federation, in accordance with which it is necessary to report to the authorities about the intention to leave the Russian Federation. Since the plaintiff, being a police officer, did not receive the necessary permission, the dismissal from the Ministry of Internal Affairs was recognized by the court as lawful.


Who else is banned from traveling abroad in 2019?

Police officers are not the only ones who need to coordinate the right to travel abroad. In accordance with Art. 24 FZ N 5485-1 "On state secrets", when issuing access to state secrets (to "especially important" and "top secret" information), an employee may be restricted from traveling abroad for the entire time he is working with such information. This restriction can be extended by the decision of the Interdepartmental Commission for 5 and 10 years after the end of work with the state secret.

For employees of the Federal Security Service (FSB), travel abroad is limited by Order No. 179 of April 17, 2012. You can leave with the permission of your superiors and if there are valid reasons, which include:

  • visiting close relatives;
  • severe health condition of close relatives;
  • the need for medical treatment abroad;
  • visiting the graves of close relatives;
  • inheritance of property;
  • alienation of property.

In all cases, the existence of a valid reason for traveling abroad must be documented.

Other grounds for restricting travel abroad for citizens of the Russian Federation, which apply not only to employees of the Ministry of Internal Affairs and the FSB, are listed in Art. 15 FZ N 114-FZ "On the procedure for leaving the Russian Federation and entering the Russian Federation."
