1. To approve the Interindustry rules for providing workers with special clothing, special footwear and other personal protective equipment in accordance with the appendix. *1)

2. To declare invalid:

I. General provisions

1. Intersectoral rules for providing workers with special clothing, special footwear and other personal protective equipment (hereinafter referred to as the Rules) establish mandatory requirements for the acquisition, issue, use, storage and care of special clothing, special shoes and other personal protective equipment (hereinafter referred to as PPE) ...

2. The requirements of these Rules apply to employers - legal entities and individuals, regardless of their organizational and legal forms and forms of ownership.

3. For the purposes of this order, PPE is understood as means of individual use used to prevent or reduce the exposure of workers to harmful and (or) dangerous production factorsas well as to protect against pollution.

4. The employer is obliged to ensure the acquisition and issuance of duly certified or declaration of conformity of PPE to workers engaged in work with harmful and (or) hazardous working conditions, as well as in work performed in special temperature conditions or associated with pollution.

PPE is purchased at the expense of the employer.

It is allowed for the employer to purchase PPE for temporary use under a lease agreement.

Employees engaged in work with harmful and (or) hazardous working conditions, as well as in work performed in special temperature conditions or associated with pollution, are provided with appropriate PPE free of charge.

5. Provision of PPE to employees, including those acquired by the employer for temporary use under a lease agreement, is carried out in accordance with the standard norms of free issuance special clothing, special footwear and other personal protective equipment (hereinafter referred to as the standard standards), which have undergone certification or declaration of conformity in the prescribed manner, and based on the results of a special assessment of working conditions.

6. The employer has the right, taking into account the opinion of the elected body of the primary trade union organization or other representative body of employees and their financial and economic situation to establish norms for the free issuance of special clothing, special footwear and other personal protective equipment to workers, which improve, in comparison with standard standards, the protection of workers from harmful and (or) dangerous factors at work, as well as special temperature conditions or pollution.

These norms are approved by local regulations of the employer on the basis of the results of a special assessment of working conditions and taking into account the opinion of the relevant trade union or other body authorized by employees and can be included in the collective and (or) labor contract with an indication of standard norms, in comparison with which the provision of workers is improved. personal protective equipment.

7. The employer has the right, taking into account the opinion of the elected body of the primary trade union organization or other representative body authorized by the employees, to replace one type of personal protective equipment provided for by the standard norms with similar ones that provide equivalent protection against hazardous and harmful production factors.

8. Issuance of PPE to employees, including those of foreign production, as well as special clothing that the employer has in temporary use under a lease agreement, is allowed only if there is a certificate or declaration of conformity confirming the compliance of the issued PPE with safety requirements established by law, as well as the availability sanitary and epidemiological conclusion or certificate of state registration dermatological PPE, issued in the prescribed manner (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

Dermatological means of personal skin protection from exposure harmful factors for use in production are subject to state registration by Rospotrebnadzor in accordance with the decrees of the Government of the Russian Federation of December 21, 2000 N 988 "On state registration of new food products, materials and products" (Collected Legislation of the Russian Federation, 2001, N 1 (part II), Article 124; 2007, No. 10, Article 1244) and (Collected Legislation of the Russian Federation, 2001, No. 17, Article 1711).


Acquisition (including under a lease agreement) of PPE that do not have a declaration of conformity and (or) a certificate of conformity or have a declaration of conformity and (or) a certificate of conformity, which have expired, are not allowed.

9. The employer is obliged to ensure that employees are informed about the PPE they are entitled to. When conducting an introductory briefing, the employee must be familiar with these Rules, as well as with the standard standards for the issuance of PPE corresponding to his profession and position.

10. The employee is obliged to correctly apply the PPE issued to him in the prescribed manner.

11. In the event of failure to provide an employee employed in work with harmful and (or) hazardous working conditions, as well as with special temperature conditions or associated with pollution, PPE in accordance with the legislation of the Russian Federation, he has the right to refuse to perform his job duties, and the employer does not have the right to demand from the employee their performance and is obliged to pay for the downtime arisen for this reason (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

II. The procedure for issuing and using PPE

12. PPE issued to employees must correspond to their gender, height, size, as well as the nature and conditions of the work they perform.

13. The employer is obliged to organize proper accounting and control over the issuance of PPE to employees in a timely manner.

The terms of use of PPE are calculated from the day they were actually issued to employees.

The issuance of PPE to employees and their delivery is recorded in the personal record card for issuing PPE, the form of which is given in the appendix to these Rules (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

The employer has the right to keep records of the issuance of PPE to employees using software (information and analytical databases). The electronic form of the record card must correspond to the established form of the personal record card for issuing PPE. At the same time, in the electronic form of a personal record card for the issuance of PPE, instead of the personal signature of the employee, the number and date of the accounting document on the receipt of PPE is indicated, on which there is a personal signature of the employee (the paragraph is supplemented by the order of the Ministry of Health and Social Development of Russia of January 27, 2010 N 28n.

The employer has the right to organize the issuance of PPE and their replaceable elements of a simple design that do not require additional instruction, by automated systems dispensing (vending equipment). This requires the personification of the employee and the automatic filling of the data on the issued PPE into the electronic form of the card for accounting for the issue of PPE.

14. When issuing PPE to employees, the employer is guided by standard standards corresponding to his type of activity.

In the absence of professions and positions in the relevant standard standards, the employer issues workers with PPE provided for by the standard standards for workers of cross-cutting professions and positions in all sectors of the economy, and in the absence of professions and positions in these standard standards, the employer issues standard standards for workers whose professions (positions) are typical for work performed.

15. Foremen, foremen, performing the duties of foremen, assistants and assistants of workers whose professions are indicated in the relevant standard standards are issued the same PPE as workers of the corresponding professions.

16. The PPE of workers, specialists and other employees provided for in the standard norms are issued to the said workers even if they are senior in their profession and position and perform directly those works that give the right to receive these personal protective equipment (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

17. Employees combining professions or constantly performing combined work, including as part of complex teams, in addition to the PPE issued to them for the main profession, are additionally issued, depending on the work performed, other types of PPE provided for by the relevant standard standards for the combined profession (combined type work) with the entry of a mark on the issued PPE in the personal record card for the issuance of PPE.

18. Employees temporarily transferred to another job, employees and other persons undergoing vocational training (retraining) in accordance with the apprenticeship agreement, pupils and students educational institutions primary, secondary and higher vocational education during the passage industrial practice (industrial training), industrial training masters, as well as other persons participating in the employer's production activities or carrying out control (supervision) measures in the established field of activity in accordance with the current legislation, PPE are issued in accordance with standard norms and Rules for the duration of this work (undergoing vocational training, retraining, industrial practice, industrial training) or the implementation of control (supervision) measures.

Employees of third-party organizations, when performing work in production shops and areas where there are harmful and (or) hazardous production factors that can affect employees, must be provided by their employer with PPE in accordance with the standard standards provided for employees of the relevant professions and positions of the organization, to which they are directed.

Managers and specialists who, in accordance with job responsibilities periodically visit production facilities (sites) and may therefore be exposed to harmful and (or) hazardous production factors, appropriate PPE should be issued as duty officers (at the time of visiting these facilities).

19. In cases where such PPE as a signal vest, a harness, a restraining harness (safety belt), dielectric galoshes and gloves, a dielectric mat, goggles and shields, filtering respiratory PPE with aerosol and gas mask filters, isolating PPE organs breathing, protective helmet, comforter, mosquito net, helmet, shoulder pads, elbow pads, self-rescuers, earmuffs, anti-noise pads, light filters, vibration-proof mittens or gloves, etc. are not specified in the relevant standard standards, they can be issued to employees with a wear period "until wear and tear" based on the results of a special assessment of working conditions, as well as taking into account the conditions and characteristics of the work performed.

The above PPE is also issued on the basis of the results of a special assessment of working conditions for periodic use when performing certain types of work (hereinafter referred to as duty PPE). At the same time, anti-noise liners, comforters, as well as PPE of the respiratory organs, which do not allow repeated use and are issued as "attendants", are issued in the form of a disposable set before a work shift in an amount corresponding to the number of people employed at a given workplace

20. Duty PPE for general use is issued to employees only for the duration of the work for which they are intended. (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

The specified PPE, taking into account the requirements of personal hygiene and the individual characteristics of workers, are assigned to certain workplaces and transferred from one shift to another (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

In such cases, PPE is issued under the responsibility of the heads of structural units authorized by the employer to carry out these works.

21. PPE, intended for use in special temperature conditions due to annual seasonal temperature changes, are issued to employees with the onset of the corresponding period of the year, and at the end of the year they are handed over to the employer for organized storage until the next season. The time for using these types of PPE is set by the employer, taking into account the opinion of the elected body of the primary trade union organization or other representative body of workers and local climatic conditions.

The timing of wearing PPE used in special temperature conditions includes the time of their organized storage.

22. PPE returned by workers after the expiration of the wearing period, but suitable for further operation, are used as intended after taking care of them (washing, cleaning, disinfection, degassing, decontamination, dust removal, disposal and repair). The suitability of the specified PPE for further use, the need for and the composition of measures for their care, as well as the percentage of wear and tear of PPE are established by an official authorized by the employer or the labor protection commission of the organization (if any) and are recorded in the personal record card for issuing PPE (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

23. PPE, rented, is issued in accordance with standard norms. When the employee is given special clothing rented by the employer, an individual set of PPE is assigned to the employee, for which the appropriate marking is applied to it. Information about the issuance of this kit is entered into the employee's personal record card and issuance of PPE.

24. When issuing PPE, the use of which requires practical skills from employees (respirators, gas masks, self-rescuers, safety belts, mosquito nets, helmets, etc.), the employer ensures that employees are instructed on the rules for using the specified PPE, the simplest ways to check their performance and serviceability, and also organizes training sessions for their use (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

25. In the event of loss or damage of PPE in the established places of their storage for reasons beyond the control of employees, the employer shall provide them with other serviceable PPE. The employer provides replacement or repair of PPE that have become unusable before the end of the wearing period for reasons beyond the employee's control (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

26. The employer ensures that employees must use PPE (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

Employees are not allowed to perform work without PPE issued to them in accordance with the established procedure, as well as with defective, not repaired and contaminated PPE.

27. Employees are prohibited from taking PPE outside the territory of the employer or the territory where work is performed by the employer at the end of the working day - individual entrepreneur... In some cases, when, according to the working conditions, the specified procedure cannot be observed (for example, at logging, at geological work, etc.), PPE remain in work time workers (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

28. Employees must inform the employer (or his representative) about the failure (malfunction) of PPE.

29. In accordance with the terms established in national standards, the employer provides testing and inspection of the operability of PPE, as well as the timely replacement of parts of PPE with reduced protective properties. After checking the serviceability, a mark (stamp, stamp) is put on the PPE on the timing of the next test (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

III. The procedure for organizing the storage and care of PPE

30. The employer at his own expense is obliged to provide care for PPE and their storage, timely carry out dry cleaning, washing, degassing, decontamination, disinfection, decontamination, dedusting, drying of PPE, as well as repair and replacement of PPE.

For these purposes, the employer has the right to provide employees with 2 sets of appropriate PPE with double the wearing period.

31. For storage of PPE issued to employees, the employer provides specially equipped rooms (dressing rooms) in accordance with the requirements of building codes and regulations.

32. If the employer does not have technical capabilities for dry cleaning, washing, repair, degassing, decontamination, decontamination and dust removal of PPE, these works are performed by an organization engaged by the employer under a civil contract.

33. Depending on the working conditions of the employer (in his structural units) dryers, chambers and installations for drying, dedusting, degassing, decontamination and neutralization of PPE are arranged (paragraph as amended by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

IV. Final provisions

34. Responsibility for the timely and full issuance of PPE certified or declared in accordance with the established procedure in accordance with the established procedure, for the organization of control over the correct use of PPE by employees, as well as for the storage and maintenance of PPE rests with the employer (his representative) ...

35. State supervision and control over compliance by the employer with these Rules is carried out by the federal executive body exercising the functions of supervision and control over compliance with labor legislation and other normative legal acts containing norms labor law, and its territorial bodies (state labor inspectorates in the constituent entities of the Russian Federation).

36. Monitoring compliance by employers (legal and individuals) of these Rules in subordinate organizations is carried out in accordance with and 370 of the Labor Code of the Russian Federation by federal executive bodies, executive bodies of the constituent entities of the Russian Federation and local self-government bodies, as well as trade unions, their associations and technical labor inspectors and authorized ( authorized) persons for labor protection.

Who is the employer obliged to issue overalls to?

Overalls are special means of personal protection of an employee from exposure to harmful or hazardous working conditions in the workplace. Overalls are provided to workers according to the norms. The categories of workers who should be provided with personal protective equipment and overalls are established by Articles 212 and 221 of the Labor Code of the Russian Federation, These include employees who are employed at work:

  • with harmful and (or) dangerous working conditions;
  • in special temperature conditions;
  • pollution related.

Officials approved the rules for providing workers with special clothing, footwear and other personal protective equipment by order of the Ministry of Health and Social Development of Russia dated 01.06.2009 No. 290.

Overalls should be distinguished from uniforms that the employer may issue to employees. Uniforms, unlike workwear, do not protect employees from external factors... It is intended to indicate affiliation with a particular organization or expresses form style... For uniforms, the rules for workwear do not apply.

New requirements for the procedure for reimbursement of expenses for injury prevention

The fund finances the purchase of personal protective equipment manufactured in Russia. Now the overalls must be made not only in Russia, but also from Russian fabrics and materials (subparagraph "g" of clause 3 of the Rules, approved by order No. 580n).

Model norms for the issuance of workwear in 2019 by profession

It is necessary to issue overalls to employees according to the rules approved by the order of the Ministry of Health and Social Development of the Russian Federation dated 01.06.2009 No. 290n. At the same time, the standard industry norms establish the professions for which overalls are mandatory, as well as the types of such clothes and the terms of use. We will provide a list of regulations that all enterprises of the Russian Federation are guided by.

In addition, there are separate standard codes that are set for different industries.

For example, the standards for workers in the pulp and paper, hydrolysis, wood chemical and woodworking industries were approved by order of the Ministry of Labor of Russia dated November 17, 2016 No. 665n. For trading companies - Resolution of the Ministry of Labor of Russia dated December 29, 1997, No. 68.

If the company cannot find the specialty of an employee in the norms of specific industries, then the standard norms for issuing PPE in 2019 by profession for all sectors of the economy from the order of the Ministry of Health and Social Development of Russia No. 997 should be used.

The employer has the right to independently develop and establish norms for the free distribution of special clothing, special footwear and other personal protective equipment to employees. But provided that these standards improve the protection of workers in comparison with typical ones.

Current industry standard norms for the free issuance of workwear in 2019

The period of wearing workwear can be set to any, taking into account the mode of its operation. And if a maximum is provided by the standard norms, then within its limits.

The “before wear” rate means that the personal protective equipment can be worn until it becomes unusable. Nevertheless, for an even write-off of PPE in accounting, it is necessary to establish a specific period of use. For example, based on the results of a special assessment of working conditions, as well as taking into account the conditions and characteristics of the work performed.

How to issue the issuance of overalls to employees

The employer must establish the procedure for issuing overalls to employees in local acts. What provisions and in what local acts to reflect, see the table below.

What are the rules for issuing overalls

When issuing personal protective equipment and overalls to employees, three rules must be followed.

Rule No. 1. An employer must apply the 2019 model rules for issuing PPE by occupation. An example of the norms for the issuance of special high visibility signal clothing, see below.

If you do not provide employees with special clothing when necessary, they have the right to stop working. In this case, it will not work to punish them within the framework of disciplinary liability. Moreover, the employer is obliged to pay employees downtime.

Sample norms for issuing signal clothing

Rule No. 2. The employer must purchase overalls at his own expense and give it to employees free of charge in accordance with the approved issuance standards. In some cases, work clothing can be purchased from accident and occupational health insurance premiums.

Rule No. 3. Personal protective equipment must be certified, produced in Russia and from Russian fabrics and materials.

Employees must wear overalls only during working hours. They have no right to take her out of the workplace. An exception is provided for individual cases when, due to the working conditions, the specified procedure cannot be observed. For example, in logging. Then the workwear can stay in non-working hours from an employee. This is stated in paragraph 27 of the Rules, approved by order of the Ministry of Health and Social Development dated 01.06.2009 No. 290n.

These requirements were approved by Order of the Ministry of Labor of the Russian Federation No. 997n dated December 9, 2014. The list includes about 200 professions. Excessive issuance of workwear

The described requirements for labor protection establish the minimum necessary kits, while the enterprise has the right to establish its own internal standards for providing workers with special equipment. This document determines the factors of choosing clothes and substantiates the presence of certain characteristics of specialized uniforms, including its quantitative issue.

One of the orders of the Ministry of Social Development regulates the provision of reflective equipment to workers in the road sector and builders. The list of protective clothing for drivers of different types of vehicles will differ. The only common thing is a work suit that is resistant to dirt and mechanical damage and gloves, which can have different properties depending on the field of activity and the category of goods transported. The list includes, according to the legislator, all working professions associated with any risks and in need of protective clothing, even if the risks are minimal, for example, for cleaners. These workers are entitled to the following PPE equipment:

Intersectoral

Inter-sectoral norms determine the procedure for the issuance of safety footwear and workwear in all sectors of the economy. Interindustry rules were approved by Order No. 290n, registered in 2009. After issuance, the employee puts a personal signature on the card. In the absence of a signature, the labor protection inspector considers that the issuance of overalls has not been made. In addition to the cards, the PPE Register is kept. The procedure for the means of protection issued in excess of the standard norms must be spelled out in the Collective agreement.

Duties of the parties

Employer

The employer buys protective equipment, overalls, safety footwear at his own expense. On its own and at its own expense, it provides cleaning, maintenance and storage of PPE, equipping changing rooms and storage lockers. Performs disinfection, degassing, dedusting, decontamination, drying, repair and replacement.

For this, the employer is given the right to issue a doubled set of overalls. At the same time, the wearing period is also doubled.

If the employer does not have the (technical) ability to clean the work clothes, then he enters into an agreement with an organization specializing in this type of service. The responsibility for the failure to provide personal protective equipment lies entirely with the employer.

The employer is obliged to replace the worn-out PPE (not through the fault of the employee). The replacement procedure takes place on the basis of the act. An employee should not take overalls out of the territory of the enterprise, do their own washing, since this is a direct violation of the law.

An early write-off is made by the commission, if no violations are found on the part of the employee in their use. In the event of damage to special footwear, overalls through the fault of the employee, a new one is issued after retaining the residual value of the spoiled one.
