Laws and acts on licensed activities in the Russian Federation

Activities requiring a license are regulated federal laws. The main document in this area is Law 99-FZ of 05/04/2011 “On licensing individual species activities." It names all the main areas of activity that are subject to licensing. It was last updated on August 3, 2018. You can download the version of the document current as of August 2018.

Article 12 of Law 99-FZ contains a list of licensed activities, consisting of 53 points (download).

Features of licensing the activities of individual entrepreneurs and LLCs

For individual entrepreneurs, unlike a legal entity, only a small list of types of licensed activities is allowed: medical ( private practice), trade in pharmaceuticals, freight and passenger transportation, transport services, as well as private search.

By law, the application and package of documents must be verified within three days. If errors are found, a month is given to eliminate them. Then, within 45 days, the commission of the licensing authority makes a decision: to issue a permit or refuse.

OKVED ( All-Russian classifier types of economic activity) is applied when state registration individual entrepreneurs (IP) and legal entities.

In 2015 used OKVED directory OK 029-2001 (NACE rev. 1) with decoding of codes. It was adopted by the Resolution of the State Standard of Russia dated November 6, 2001 No. 454-st. OKVED structure

The directory consists of 17 sections, designated in Latin letters (A-Q) and 16 subsections (CA, CB, DA-DN). They are broken down into smaller classes, subclasses, groups, subgroups and species, represented by two to six Arabic numerals separated by dots.

Selection of OKVED codes

When registering a new organization, the question of selecting types of economic activity arises. It is important to know that they are all selected strictly according to OKVED codes.

To find the right code, you should first decide on the area of ​​activity of the organization (for example, textile production), then find the required section or subsection (for example, DB). Further delve into the class, subclass, group, subgroup and type until a specific type of economic activity is determined.

  • The selection of codes does not depend on the form of ownership of the organization: they are identical for individual entrepreneurs, LLCs, and CJSCs.
  • The selected code must consist of at least 4 digits, i.e. be the name of a group (XX.XX), subgroup (XX.XX.X) or type (XX.XX.XX).
  • An unlimited number of codes can be indicated in the constituent documents (preferably no more than 20).
  • When registering, one main code is indicated (the core activity of the organization) and additional ones (non-core activities or activities in the near future).
  • When choosing types of economic activities, you should remember that some of them require licensing.
  • You can make changes to the list of codes (add or delete) at any time.

To carry out certain types of activities on the territory of the Russian Federation, legal entities and individual entrepreneurs must obtain the appropriate license. A package of documents for obtaining a license is submitted immediately after completion of the registration procedure of an economic entity. Why is a license issued?

A license is a certificate giving an entrepreneur the right to conduct a certain type of activity (sales, performance of work, provision of services). For getting permit document the interested party must fulfill all licensing requirements established for equipment, premises, employee qualifications, etc. The presence of an organization or individual entrepreneur with a license is confirmation that they operate legally and safely for consumers.

Types of activities subject to licensing in 2019 (according to OKVED, the main ones are shown in the table) can be found in Art. 12 of the law on licensing dated May 4, 2011 No. 99-FZ (as amended on October 30, 2018), which specifies 53 types of such activities. In addition, other areas of business regulated by separate laws may be subject to licensing. For example:

Beginning entrepreneurs must figure out which types of their activities are licensed by selecting them from the list of OKVED codes. This process will require special care, since the names of some types of activities are identical in the classifier and the relevant laws, while the names of other types may not be the same.

Types of activities subject to licensing in 2019, according to OKVED

Applicants for a license must compare the types of activities with those for which codes are defined in the OKVED classifier. If, during an inspection of an organization by tax officials, it is revealed that the company has a “licensed” OKVED registered in the Unified State Register of Legal Entities, but it operates under this type without a license, the company will be fined. The inspectors will consider that the economic entity is engaged in a licensed type of activity without permission.

The easiest way to identify “licensing” codes is to compare current types of activities or those that a legal entity plans to enter into the Unified State Register of Legal Entities with types of businesses that are subject to mandatory licensing.

The resulting list of licensed activities in 2019 according to OKVED is compared with the OK 029-2014 classifier (NACE Rev. 2). Today it is the only active classifier according to OKVED in the Russian Federation. In it, all types of activities are grouped into sections. Each section consists of classes, subclasses, groups, subgroups.

The OKVED code consists of a set of numbers separated by dots. Finding the code for a specific type of activity is not difficult. First, select the name of a specific section, and then, in descending order, correlate it with the name of each (smaller) register. It is important to consider that one type of activity may correspond to several similar OKVED codes, from which you need to choose the correct one.

Therefore, before talking about how to get one, you should know what activities must be licensed.

Licensing in our country is carried out on the basis of Law No. 99-FZ “On licensing of certain types of activities” dated 05/04/2011. According to the provisions of Art. 12 of the above law, the list of activities subject to licensing includes:

  1. Development, production and sales information media or systems aimed at encrypting any kind of information. An exception to this clause are funds or systems intended only for personal or household needs of individuals. or legal persons At the same time, this item includes the design and manufacture of protective equipment confidential information and activities related to technical protection thereof.

This is due to the fact that the legislator regulates in some detail the procedure for obtaining a license in this industry, since it is the state that is the guarantor of the citizen’s constitutional right to health care. How to get a license?

To obtain an organization license or individual entrepreneur a package of documents specified by law must be submitted to the specialized licensing body. This kit may differ depending on what kind of activity is licensed in a particular case. In the very general view the list looks like this:

  1. Application for a license. The requirements for such a document are set out in Part 1 of Art. 13 Federal Law “On licensing of certain types of activities”. According to the norms of this article, it should indicate the name of the company/organization, INN, OGRN (OGRIP), the type of activity subject to licensing, details of documents confirming payment of the state duty and necessary for licensing a specific activity.
  2. Copies of papers that are identified as necessary to obtain a license to carry out a certain type of activity.
  3. List of documents attached to the application.

It should be noted that the application indicating the type of activity subject to licensing must be signed by the head of the legal entity. person or other person authorized to perform such actions. You can submit it and the documents attached to it at electronic form(provided that the document is certified by an electronic signature).

Within 3 days from the date of receipt by the licensing authority, the documents must be reviewed, after which a decision is sent to the applicant to accept the documents submitted by him for consideration or a reasoned refusal to do so. Refusal may result from the application not meeting the requirements established by law, or from providing an incomplete set required for licensing. In both cases, 30 days are given to eliminate violations identified during the inspection. If they are not eliminated during this time, the application along with other documents is returned by the licensing authority to the applicant.

The licensing authority has 45 days to review the papers submitted by the applicant. During this period, the submitted set of documentation is checked for completeness and accuracy. Based on the results of the inspection, the licensing authority must decide to issue a license or refuse it. This decision must be properly formalized (by order or regulation). No later than 3 days from the moment of its acceptance and issuance of the relevant order/instruction, the applicant must be served (or sent through registered letter with notification) a license, or a reasoned refusal to issue one with references to regulations, which served as the basis for making a negative decision.

Re-registration of the received document may be required only if the licensee’s data changes (they may relate to the legal form, name of the company/organization, full name, location, details of the document designed to confirm the identity of a citizen who is an entrepreneur, etc.), as well as in the event of a change in the types of activities, i.e. the list of works/services carried out (provided) by the licensee.
