When developing labor functions for a new position, the problem of harmonious combination of the pedagogical and library components arose, since for the first time in the domestic educational practice it was necessary to integrate two self-sufficient areas of activity into one. It was extremely important to avoid "bias" or careless interpretation of the official duties of teacher-librarians and, in our opinion, this was possible thanks to a strong base professional retraining, study foreign experience and the needs of employers. For the rest, the success of introducing a new position into the educational complex depends on the managerial talent and efforts of school principals, who, on the one hand, must strictly monitor the implementation of the implementation of the new professional standard for librarians, and on the other hand, assess the situation critically, with the understanding that in real life educational conditions, everything should work to meet the needs of schoolchildren and teachers, and therefore it is possible to carry out correction, adjusted for the specifics of the functioning of a particular educational institution.

Teacher-librarian at school: job responsibilities

The definition of duties for the position of a teacher-librarian is based on a professional standard, the creators of which, in turn, identified specific labor functions on the basis of generalized ones, providing a set of library and pedagogical components. As far as practical activities are concerned, in the exercise of professional duties, a teacher-librarian occupying a new position at a school must be guided by the job description, local acts and regulations, a work program that he develops before the start of the school year and agrees with the school administration. A specialist's work plan for a year should reflect a wide range of goals and objectives (organizational, educational, prognostic, monitoring), corresponding to a wide scope of labor functions that combine the pedagogical and library components. Can a librarian teacher engage in teaching activities?

According to the current qualification characteristics, the teacher-librarian, in addition to maintaining the information fund on the balance sheet and conducting consulting activities, is charged with pedagogical work that is not subject to additional payment. The pedagogical work of a specialist working as a "teacher-librarian" is to participate in the implementation of the educational program by providing information to educational disciplines and forming the information culture of students.

Raising the question of whether a teacher-librarian can engage in teaching activities, I would like to note that an employee who has the appropriate training and a desire to organize the education of children in a subject, course, within the framework of a circle activity, has the right to teach on the same grounds as other employees of the educational institution - the director, his deputies, educational psychologists, etc. Since the teaching activity of the teacher-librarian is not provided for by the TSA, the hours of the approved curriculum must be paid separately, at the rate of the teacher of the main or additional education (depending on the type of discipline). At the same time, the head should take into account that the teaching load without occupying a full-time position is not considered part-time, therefore it can be realized during the main working hours, if this does not interfere with the teacher-psychologist from performing basic job duties and is agreed with the administration of the educational institution.

Summing up, I would like to note that the school director has the right to independently decide on the names of employee positions and staffing educational institution, which is confirmed by Art. 32 ФЗ № 273-ФЗ dated December 29, 2012 “On education in the Russian Federation”. Since both for the librarian and for the teacher-librarian the organization of work to ensure free access of the educational process participants to the library fund is the main thing, it is not necessary to ensure the introduction of a new position. So, librarians and teacher-librarians can work together in large schools that have significant material, technical and financial resources, but for small educational organizations this management decision is impractical. At the same time, if the staffing table does not provide for the possibility of remuneration for a librarian, then it is necessary to legally organize the transfer of the interested employee to a new position or, having prepared the necessary documentation support, open an appropriate vacancy that more fully meets the current staffing needs and educational needs.

The procedure for introducing the position of a teacher-librarian into the staff of an institution

The emergence of a new position of employees and the approval of the qualification characteristics of the position of “teacher-librarian” does not mean that all positions of librarians, including librarians, must be excluded from the staffing tables of institutions, according to the job description of a librarian-teacher.

Bodies exercising management in the field of education are not entitled to give instructions to educational institutions on amending their staffing tables, including on the exclusion of the place of a librarian and staffing table schools of the position of a teacher-librarian, since in accordance with Art. 32 of the Law of the Russian Federation of 10.07.1992 No. 3266-1 "On Education" (hereinafter - the Law of the Russian Federation "On Education"), the establishment of the structure and staffing of an educational institution is attributed to the competence of the educational institution itself.

Hence, heads of institutions have the right to independently make decisions on staffing and the names of positions of employees who will ensure work with library fund and information resources in the institution, since this activity is the main one for both the librarian and the teacher-librarian.

In large educational institutions with a large number of classes, provided there are objective working conditions for teachers and financial opportunities in school libraries, work can be performed by several specialists, including librarians and teachers-librarians.

Therefore, if the institution considers it appropriate, taking into account the available resources, including financial capabilities, to have the position of a teacher-librarian on the staff, then for this, it is necessary to make the appropriate changes to the staffing table of the institution.If the staffing table provides for a librarian vacancy, but does not intend to retain it, then this vacancy should be removed from the staffing table and another required position introduced.

If the position of a librarian is occupied, then after the issuance of the relevant order on making changes to the staffing table, the employer will need to take a number of actions provided for the reduction of teaching staff, including:

notify the specialist in writing, against signature, at least two months in advance of a possible dismissal due to staff reduction and offer him an existing job (both for a vacant position or the relevant qualifications of a specialist, and a vacant lower position or lower-paid job), which the specialist can perform taking into account his state of health (the employer is obliged to offer the specialist all the vacancies that meet the specified requirements that he has in the area);

notify in writing, no later than two months before the start of the relevant event, the state employment service bodies (clause 2 of article 25 of the Law of the Russian Federation of April 19, 1991 No. 1032-1 (as amended on July 11, 2011) "On employment in the Russian Federation ") and the elected body of the primary trade union organization of this institution (part 1 of article 82 of the Labor Code of the Russian Federation (hereinafter referred to as the Labor Code of the Russian Federation)).

If a specialist holding the position of a librarian agrees to the employer's offer to transfer to the position of a teacher-librarian, then his employment contract is amended accordingly by concluding an additional agreement. Taking into account that the employee's work function is changing, as well as the terms of the employment contract, it is advisable to provide for the statement of the employment contract in a new edition in the supplementary agreement. In addition, the employer issues an order to transfer the employee to this position.

If the specialist refuses to transfer to another place or if the employer does not have a job corresponding to the qualifications of the employee (including when the employee who held the position of a librarian does not have the higher education required to take the position of a teacher-librarian), an employment contract upon expiration two months is terminated under clause 2 h. 1 of Art. 81 of the Labor Code of the Russian Federation.

Dismissal of workers who are members of the trade union, on the grounds provided for in paragraph 2 of part 1 of Art. 81 of the Labor Code of the Russian Federation, produced in accordance with Art. 373 of the Labor Code of the Russian Federation, taking into account the motivated opinion of the elected body of the primary trade union organization and the provision of social and labor guarantees in connection with the reduction in the number or staff of employees (payment of severance pay, preservation of average earnings for the period before employment, etc.).

Violation by the employer of the procedure established by law for dismissal of a specialist to reduce the number or staff in court may result in: recognition of the dismissal as illegal and unjustified; restoration of an employee to previous work; payment of average earnings to him for the period of forced absence and compensation for moral damage; legal liability of the employer for violation of labor laws.

It should also be borne in mind that in certain cases, when the employer decides on the recruitment of personnel, including when appointing to the position of a teacher-librarian or transferring a librarian to this position, it is allowed to hire (transfer) persons whose qualifications do not meet the requirements of qualification characteristics, for which the special provisions contained in the section "General Provisions" of the Qualification characteristics of the positions of educational workers are applied.

So, clause 9 of the section "General Provisions" of the Qualification characteristics of positions of educational workers provides that persons who do not have special training or work experience established in the section "Requirements for qualifications", but have sufficient practical experience and competence, perform efficiently and in full to the extent assigned to them official duties, on the recommendation of the attestation commission, can be appointed to the relevant vacancies in the same way as persons with special training and work experience.

Positions of employees in libraries of institutions and their functional responsibilities

When deciding on the job recruitment (names of vacancies) of libraries of institutions, it is necessary to take into account the differences in the job responsibilities of librarians and a teacher-librarian.

The duties of librarians are determined by the qualification characteristics approved by the order of the Ministry of Health and Social Development of Russia dated March 30, 2011 No. 251n "On the approval of the Unified qualification reference book for the positions of managers, specialists and employees, the section" Qualification characteristics of positions in culture, art and cinematography workers " 2011, registration number 20838).

It should be borne in mind that the performance of pedagogical activity is not included in the official duties of librarians, therefore, if it is actually performed with the consent of the employees, such pedagogical work should be paid additionally.

Thus, if there is appropriate training, school librarians, like other workers educational institutions (leaders, their deputies, educational psychologists, educators, etc.) can carry out teaching activities on any academic subject, course, discipline or a separate topic that are provided for by the curriculum or educational program, or conduct classes in a circle.

For teaching work, library specialists must be paid additional payment in the manner and on the conditions established for teachers or teachers of additional education, depending on its content. At the same time, teaching work carried out in addition to the main work in the same educational institution without occupying a full-time position is not considered part-time and can, with the permission of the head of the institution, be performed during the main working hours.

Librarian, according to the approved qualification characteristic, in addition to working with the library fund and information resources charged with duty pedagogical work.It can be associated with participation in the implementation of the main educational program of primary general, basic general, secondary (complete) general education, as well as with the implementation of additional education for students, pupils in the cultural development of personality, promotion of reading, support of interest in literature, the development of literature and the formation of information culture , the development of innovative technologies, methods and forms of library and information activities in the circle, club and other forms of work. Pedagogical work, which is part of the basic duties of a teacher-librarian, is not subject to additional payment.

At the same time, it should be specially noted that at the suggestion of the All-Russian Trade Union of Educational Workers, when agreeing on the draft qualification characteristics of the position "teacher-librarian" from the section "Job responsibilities", functions such as the implementation of the educational process in accordance with the basic educational program of the initial general, basic general , secondary (complete) general education, conducting training sessions. These functions are the direct responsibilities of teachers and cannot at the same time be included in the job duties of another employee, even if we call his place “teacher-librarian”, since one of his main functions remains to work with the library fund and information resources.

Labor and other rights and obligations of teachers-librarians

According to the order of the Ministry of Health and Social Development of Russia dated 05/31/2011 No. 448n, the position of "teacher-librarian" has been supplemented with a section of qualification characteristics of educational workers, called "Posts of pedagogical workers." It means that the vacancy "teacher-librarian" is attributed to the positions of teaching staff.

At the same time, referring the position of a teacher-librarian to the category of pedagogical workers does not in itself mean that the employee who will occupy the indicated place will automatically be subject to most of the guarantees established for pedagogical workers, since they are determined depending on the place occupied, the type and type of educational institutions and are regulated both directly by legislative acts of the Russian Federation and by other regulatory legal acts of the Russian Federation, which must be supplemented with appropriate additions regarding the position of a teacher-librarian.

Hence the implementation certain rightsestablished by the legislation of the Russian Federation for teachers, at the present time it is directly dependent on how quickly the necessary additions will be made to the relevant by-laws, and above all:

  • to the order of the Ministry of Education and Science of the Russian Federation of 24.12.2010 No. 2075 "On the duration of working time (the norm of hours of teaching work at the rate of wages) of teaching staff" (entered into force on July 4, 2011), which regulates shorter working hours pedagogues;
  • decree of the Government of the Russian Federation of 01.10.2002 No. 724 "On the duration of the main annual extended paid leave provided to teachers" (with amendments and additions), which determines the duration of the annual principal.

In addition, it is also necessary to make amendments and additions to other regulatory legal acts that determine the procedure for the implementation of rights and measures. social support teaching staff, provided for in Art. 55.

So, teachers of educational institutions, in the manner prescribed by the legislation of the Russian Federation, enjoy the right to receive pensions for long service (prescheduled old-age retirement pension) until they reach retirement age.

At the same time, a retirement pension in connection with teaching activities is assigned ahead of schedule if work has been carried out for at least 25 years in institutions and positions provided for by the List of jobs, professions, positions, specialties and institutions, taking into account which an old-age retirement pension is assigned ahead of schedule. However, since the vacancy of a teacher-librarian is not provided for by the specified List, work in this position will not be taken into account when assigning this pension. To change the situation, the addition of the specified List is required, and in case of a positive decision, the presence of the length of service required for its appointment for 25 years in certain positions in accordance with the List.

Educators living and working in countryside, workers' settlements (urban-type settlements) have the right to provide reimbursement of expenses for housing, heating and lighting... The amount, conditions and procedure for reimbursement of expenses associated with the provision of these measures of social support to teachers of educational institutions of the constituent entities of the Russian Federation and municipalities, are established by the legislation of the constituent entities of the Russian Federation and are provided at the expense of the budgets of the constituent entities of the Russian Federation. Whether teachers-librarians will be able to use these measures of social support will depend on the legislative and other by-laws adopted in the constituent entities of the Russian Federation.

If the pedagogues of federal government agencies the amount of monthly monetary compensation in order to facilitate their provision with book publishing products and periodicals is provided for in paragraph 8 of Art. 55 of the Law of the Russian Federation "On Education", then pedagogical workers of state educational institutions under the jurisdiction of the subjects of the Russian Federation, specified financial compensation paid by decision of the authority state power subject of the Russian Federation in the amount established by the specified body, and for teachers of municipal educational institutions - by decision of the local government in the amount established by the specified body.

In accordance with para. 3 p. 5 art. 55 of the Law of the Russian Federation "On Education", teachers of an educational institution have at least every 10 years of continuous teaching the right to long leave of up to one year, the procedure and conditions for the provision of which are determined by the founder and (or) the charter of the given educational institution, taking into account the list of positions, work in which is counted in the experience of continuous teaching. If the teacher-librarian will simultaneously conduct teaching in the position of a teacher, in order to exercise this right on the specified conditions, it is necessary to provide for this position in this list.

In accordance with federal state requirements for the minimum content of an additional professional educational program and the level of their professional retraining, teachers of an educational institution have the right to undergo professional retraining or advanced training at least once every five years.These requirements have been established by the federal executive body responsible for the development of state policy and legal regulation in the field of education.

Consequently, federal state requirements should be established for the minimum content of an additional professional educational program and the level of professional retraining of teachers-librarians, and educational institutions implementing educational programs for professional retraining or advanced training should develop appropriate programs for teacher-librarians, taking into account that in educational institutions of higher professional education do not train such specialists.

Thus, the basic rights of pedagogues provided for by the Law of the Russian Federation "On Education", as well as academic, labor and other rights established by other federal laws, model provisions on educational institutions of the corresponding types and types and other regulatory legal acts, can be extended to teachers. librarians. As a rule, this is possible only on the basis of subordinate normative legal acts, the adoption of which must be initiated by the federal executive body carrying out state policy in the field of education, as well as by other authorized authorities.

In addition, it should also be borne in mind that teachers-librarians should be subject to the rights and obligations of teachers established by the legislation of the Russian Federation.

Certification of teacher-librarian

The duties of teaching staff include the obligation to undergo certification in order to confirm the suitability for the position held, which is held once every 5 years in relation to teachers who do not have qualification categories (first or highest). The procedure for attestation of pedagogical workers of state and municipal educational institutions was approved by order of the Ministry of Education and Science of the Russian Federation dated March 24, 2010 No. 209 "On the procedure for attestation of pedagogical workers of state and municipal educational institutions" and entered into force on January 1, 2011.

At the same time, it should be borne in mind that in accordance with paragraph 18 of the specified order, teachers who have worked in their position for less than two years are not subject to certification. Thus, specialists who have held the position of a teacher-librarian for less than two years, as well as received the first qualification category during the first two years of work in this position, cannot be represented by the employer for attestation in order to confirm their suitability for the position.

The rights associated with certification include the right of a teacher-librarian to undergo certification in order to establish the compliance of the level of his qualifications with the requirements for the first qualification category, which is carried out on the basis of an application by a teacher in accordance with the established procedure. The librarian teacher has the right to apply for certification to establish the compliance of the qualification level with the requirements for the highest qualification category no earlier than 2 years after the first qualification category has been established for him. At the same time, a comprehensive analysis of the results of the professional activities of teachers-librarians should be carried out on the basis of the requirements for qualification categories, as well as taking into account the peculiarities of their activities in the performance of official duties, provided for by the qualification characteristics.

Conditions for the performance of additional pedagogical work by teachers-librarians

In addition to pedagogical work, which is the responsibility of pedagogical librarians and is not subject to additional payment, these employees in the same educational institution, if they have appropriate training, can carry out teaching work in the academic subject. Such work, as well as for other employees, can be allowed during the main working hours, since it is not considered part-time and payable in the manner and under the conditions established for teachers.

Regulation of the conditions of remuneration of teachers-librarians

The unified system of remuneration for teaching staff of state and municipal educational institutions, as envisaged before January 1, 2005, when applied throughout the Russian Federation. tariff scale, currently not installed.

In accordance with Art. 135 of the Labor Code of the Russian Federation, the salary of an employee, including a teacher-librarian, is established by an employment contract in accordance with the current employer's wage system.

Pay systems, including sizes tariff rates, salaries (official salaries), wage rates, additional payments and allowances of a compensatory nature (including for work in conditions deviating from normal), as well as incentive bonus and bonus systems and bonus systems are established by collective agreements, agreements, local regulatory acts in accordance with labor legislation and other regulatory legal acts containing labor law norms.

Local regulations establishing wage systems are adopted by the employer taking into account the opinion of the representative body of workers (the elected body of the primary trade union organization of this institution).

The terms of remuneration determined by the labor contract cannot be worsened in comparison with the conditions established by labor legislation and other regulatory legal acts containing labor law norms (collective agreement, agreements, local regulations). And the terms of remuneration determined by the collective agreement (agreements, local regulations) cannot be worsened in comparison with the conditions established by labor legislation and other regulatory legal acts containing labor law norms.

So, in accordance with Art. 144 of the Labor Code of the Russian Federation municipal institutions must establish wage systems determined by collective agreements, agreements, local regulations in accordance with federal laws and other regulatory legal acts of the Russian Federation, as well as laws and other regulatory legal acts of the constituent entities of the Russian Federation and regulatory legal acts of local authorities. These documents must not contradict the norms of federal legislation.

Consequently, appropriate changes should be made to regional and municipal regulations on the remuneration of education workers, as well as to collective agreements of institutions and regulations on remuneration at school.

It follows from the above that the regulation of the issues of remuneration of teachers-librarians, including when performing work in rural areas, will be carried out in different ways: taking into account the norms of legislative and other normative legal acts of the constituent entities of the Russian Federation and local authorities (incl. h. depending on their financial situation), as well as taking into account local regulations adopted directly by institutions.

In addition, it should be borne in mind that if the remuneration system for specialists of an educational institution is built on the basis of professional qualification groups of positions of educational workers approved by order of the Ministry of Health and Social Development of Russia dated 05.05.2008 No. 216n "On the approval of professional qualification groups of positions of educational workers", then the position of a teacher-librarian this order is currently not provided. Consequently, for this position, the qualification level has not been determined, in accordance with which the differentiation of the sizes of official salaries (wage rates) of teachers is determined.

Considering this circumstance, the All-Russian Trade Union of Educational Workers proposed the Ministry of Education and Science of Russia to attribute the position of a teacher-librarian to the fourth qualification level professional qualification group of positions of pedagogues, as well as prepare the necessary drafts of normative legal acts related to the regulation of rights and measures of social support in relation to pedagogical librarians, which were indicated by the authors in this comment.
