2. Pedagogical worker of an organization engaging educational activities, including as individual entrepreneur, it is not entitled to provide paid educational services to the student in this organization, if it leads to a conflict of the interests of the pedagogical worker.

3. Pedagogical workers are prohibited to use educational activities for political agitation, coercive students to adopt political, religious or other convictions or the abandonment of them, to incite social, racial, national or religious retail, for agitation, promoting exclusivity, superiority or inferiority of citizens on the basis of Social, racial, national, religious or language affiliation, their relationship to religion, including through the report of students' unreliable information about the historical, national, religious and cultural traditions of peoples, as well as to encourage students to actions contrary to the Constitution of the Russian Federation.

4. Pedagogical workers are responsible for failure to fulfill or improper performance entrusted to them in the manner and in cases established by federal laws. Failure or improper performance of pedagogical workers of the duties stipulated by part 1 of this article is taken into account when the certification is passed.

1. The certification of pedagogical workers is carried out in order to confirm the conformity of pedagogical workers by their posts on the basis of assessing their professional activities and at the request of pedagogical workers (with the exception of pedagogical workers from the professorship-teaching staff) in order to establish qualification category.

4. The procedure for holding the certification of pedagogical workers is established by the federal executive body, carrying out functions on the development of state policy and regulatory legal regulation in the field of education, in coordination with the federal executive body, carrying out functions on the development of public policy and regulatory labor regulation in the field of labor .

In organizations carrying out educational activities on the implementation of educational programs of higher education and additional professional programsThe posts of pedagogical workers and scientists who relate to scientific and pedagogical workers are envisaged. 2. Scientific workers of educational organizations along with the rights stipulated by law on science and state scientific and technical policy are entitled:

3) choose methods and means of conducting scientific research that meets the measures of security, the most fully relevant to the features of scientific research and ensuring their high quality;

4) For free use of educational, methodological and scientific services of the educational organization in the manner prescribed by the legislation of the Russian Federation or local regulatory acts of the educational organization.

3. Scientific workers of the educational organization Along with the duties stipulated by the legislation on science and state scientific and technical policy are required:

2) develop independence, initiative, creativity.

1. Head of the educational organization in accordance with the legislation of the Russian Federation and the Charter of the educational organization:

1) elected general meeting, conference of employees (general meeting, conference of employees and students) of the educational organization, with the subsequent approval by the founder of the educational organization;

2) appointed by the founder of the educational organization;

3) is appointed by the President of the Russian Federation in cases established by federal laws;

4) appointed by the Government of the Russian Federation (for the rectors of federal universities).

2. Candidates for the position of the head of the educational organization should have a higher education and comply with the qualification requirements specified in the qualification directories, according to the relevant posts of educational institutions and (or) professional standards.

3. It is prohibited to occupy the position of the head of the educational organization by persons who are not allowed for pedagogical activities on the grounds established by labor legislation.

4. Candidates for the position of head of the state or municipal educational organization and its leader (with the exception of the managers specified in paragraphs 3 and 4 of Part 1 of this article) undergo compulsory certification. The procedure and deadlines for the certification of candidates for the position of the head and head of the state or municipal educational organization are established by the founders of these educational organizations. In cases established by the legislation of the Russian Federation, candidates for the position of the head of the Federal State Educational Organization are also agreed with the Federal State Commissioner of the Russian Federation.

5. Official duties The head of the state or municipal educational organization, a branch of a state or municipal educational organization cannot be ordered part-time.

6. The rights and obligations of the head of the educational organization, its competence in the management of the educational organization are determined in accordance with the legislation on the formation and charter of the educational organization.

7. Heads of educational organizations are provided in the manner prescribed by the Government of the Russian Federation, the rights, social guarantees and social support measures provided for for pedagogical workers in paragraphs 3 and 5 of part 5 and part 8 of Article 47 of this Federal Law.

8. The head of the educational organization is responsible for the management of the educational, scientific, educational work and organizational and economic activities of the educational organization.

9. Features of the replacement of posts, appointments for the posts and status of the head of the Federal State Educational Organization, carrying out training in the interests of the defense and security of the state, ensuring the legality and law enforcement, are determined in the manner prescribed by federal laws.

10. Features of election, appointment and status of the head of a private educational organization are determined in the charter of a private educational organization in accordance with labor law.

11. In the educational organization of higher education by decision of its scientific council, the position of president of the educational organization of higher education may be established.

12. The combination of the posts of rector and the president of the educational organization of higher education is not allowed.

13. The procedure for election of the president of the educational organization of higher education and its powers are determined by the charter of the educational organization of higher education.

14. After the election of the president of the state or municipal educational organization of higher education between him and the founder of this educational organization is an employment contract for up to five years. Termination labor contract The President of the State or Municipal Educational Organization of Higher Education is carried out on the basis of established labor legislation, including on the basis of termination of an employment contract with the head of this educational organization.

1. In educational organizations, along with the posts of pedagogical workers, scientists provide for the posts of engineering and technical, administrative and economic, industrial, educational, medical, medical and other employees who carry out auxiliary functions.

2. The right to occupy posts provided for by part 1 of this article have persons responsible for qualifying requirements specified in qualifying reference books, and (or) professional standards.

3. Rights, duties and responsibilities of employees of educational organizations, holding positions specified in paragraph 1 of this article, are established by the legislation of the Russian Federation, the charter, the rules of the domestic labor regulation and other local regulatory acts of educational organizations, job descriptions and employment contracts.

4. Deputy heads of educational organizations, managers structural units And their deputies are provided in the manner prescribed by the Government of the Russian Federation, the rights, social guarantees and social support measures provided for by pedagogical workers in paragraphs 3 and 5 of Part 5 and part 8 of Article 47 of this Federal Law.
