When developing labor functions for a new position, the problem of a harmonious combination of the pedagogical and library components arose, since for the first time in domestic educational practice it was necessary to integrate two self-sufficient areas of activity into one. It was extremely important to avoid “skewed” or careless interpretation of the job responsibilities of educators-librarians, and, in our opinion, this was possible thanks to a strong base professional retraining, studying foreign experience and the needs of employers. Otherwise, the success of the introduction of a new position in the educational complex depends on the managerial talent and efforts of school principals, who, on the one hand, must strictly monitor the implementation of the introduction of a new professional standard for librarians, and, on the other hand, evaluate the situation critically, with an understanding that in real educational conditions, everything should work to meet the needs of schoolchildren and teachers, and therefore it is possible to carry out a correction, adjusted for the specifics of the functioning of a particular educational institution.

Teacher-librarian at school: job responsibilities

The definition of duties for the position of a teacher-librarian is based on a professional standard, the creators of which, in turn, singled out specific labor functions on the basis of generalized ones, providing a set of library and pedagogical components. With regard to directly practical activities, in the performance of professional duties, a teacher-librarian who occupies a new position in a school must be guided by the job description, local acts and regulations, the work program, which he develops before the start of the school year and coordinates with the school administration. Can a librarian teach?

According to the current qualification characteristics of a teacher-librarian, in addition to servicing the information fund available on the balance sheet and conducting consulting activities, pedagogical work is charged, which is not subject to additional payment. The pedagogical work of a specialist working as a "teacher-librarian" is to participate in the implementation of the BEP by providing information to academic disciplines and forming the information culture of students.

Raising the question of whether a teacher-librarian can engage in teaching activities, I would like to note that an employee who has the appropriate training and desire to organize the teaching of children in a subject, course, as part of circle activity, has the right to engage in teaching on the same grounds as other employees of the educational institution - the director, his deputies, educational psychologists, etc. Since the teaching activity of a teacher-librarian is not provided for by the CSA, the working hours of the approved curriculum must be paid separately, at the rate of a teacher of basic or additional education (depending on the type academic discipline). At the same time, the leader should take into account that the teaching load without classes position is not considered a part-time job, therefore it can be implemented during the main working hours, if this does not prevent the educational psychologist from performing basic job duties and is agreed with the administration of the educational institution.

Summing up, I would like to note that the director of the school has the right to independently decide on the names of the positions of employees and staffing educational institution which confirms Art. 32 of the Federal Law No. 273-FZ of December 29, 2012 “On Education in the Russian Federation”. Since the organization of work to ensure free access of participants in the educational process to the library fund is the main one for both the librarian and the teacher-librarian, it is not necessary to ensure the introduction of a new position. The procedure for introducing the position of a teacher-librarian to the staff of the institution

The appearance of a new position of employees and the approval of the qualification characteristics of the position of "teacher-librarian" does not mean that all positions of library workers, including heads of libraries, must be excluded from the staff lists of institutions, according to job description librarian-teacher.

The bodies exercising management in the field of education are not entitled to instruct educational institutions to make changes to their staffing tables, including the exclusion of the position of a librarian and to replace it with staffing schools of the position of a teacher-librarian, since, in accordance with Art. 32 of the Law of the Russian Federation of July 10, 1992 No. 3266-1 “On Education” (hereinafter referred to as the Law of the Russian Federation “On Education”), the establishment of the structure and staffing of an educational institution is within the competence of the educational institution itself.

Consequently, heads of institutions have the right to independently make decisions on the staffing and naming of positions of employees who will ensure work with library fund and information resources in the institution, since this activity is the main one for both the librarian and the teacher-librarian.

In large educational institutions with a large number of classes, in the presence of objective working conditions for teachers and financial opportunities in school libraries, work can be performed by several specialists, including both librarians and librarian teachers.

Therefore, if the institution deems it appropriate, taking into account the available resources, including financial opportunities, to have the position of a teacher-librarian on the staff, then To do this, it is necessary to make appropriate changes to the staffing of the institution. If the staffing table provides for a vacancy for a library worker, but it is not expected to be retained, then this vacancy should be excluded from the staffing table and another required position should be introduced.

If the position of a librarian is occupied, then after the issuance of an appropriate order to amend the staffing table, the employer will need to carry out a number of actions provided for when reducing teaching staff, including:

notify the specialist personally in writing against signature at least two months in advance of a possible dismissal due to staff reduction and offer him an available job (both for a vacant position or the corresponding qualification of a specialist, and a vacant lower position or lower-paid job), which the specialist can perform taking into account his state of health (the employer is obliged to offer the specialist all the vacancies that meet the specified requirements that he has in the given area);

notify in writing no later than two months before the start of the relevant event government bodies employment services (clause 2, article 25 of the Law of the Russian Federation dated April 19, 1991 No. 1032-1 (as amended on July 11, 2011) “On employment in the Russian Federation”) and the elected body of the primary trade union organization this institution (part 1 of article 82 of the Labor Code of the Russian Federation (hereinafter referred to as the Labor Code of the Russian Federation)).

If a specialist holding the position of a librarian agrees to the employer's proposal to transfer to the position of a teacher-librarian, then appropriate changes are made to his employment contract by concluding an additional agreement. Taking into account that the employee's labor function changes, as well as the terms of the employment contract, it is advisable to additional agreement provide for the presentation of the employment contract in a new edition. In addition, the employer issues an order to transfer the employee to this position.

If a specialist refuses to be transferred to another place or if the employer does not have a job corresponding to the qualifications of the employee (including when the employee who held the position of a librarian does not have higher education required to occupy the position of a teacher-librarian), the employment contract after two months is terminated according to paragraph 2 of part 1 of Art. 81 of the Labor Code of the Russian Federation.

Dismissal of employees who are members of the trade union, on the grounds provided for in paragraph 2 of part 1 of Art. 81 of the Labor Code of the Russian Federation, produced in accordance with Art. 373 of the Labor Code of the Russian Federation, taking into account the reasoned opinion of the elected body of the primary trade union organization and the provision of social and labor guarantees in connection with the reduction in the number or staff of employees (payment of severance pay, maintaining average earnings for the period before employment, etc.).

Violation by the employer of the procedure established by law for the dismissal of a downsizing specialist or staff in judicial order may entail: recognition of the dismissal as illegal and unreasonable; reinstatement of an employee previous work; payment to him of average earnings for the time of forced absenteeism and compensation for non-pecuniary damage; legal liability of the employer for violation of labor laws.

It should also be taken into account that in certain cases, when the employer decides on recruitment issues, including when appointing a teacher-librarian or transferring a librarian to this position, it is allowed to hire (transfer) persons whose qualification level does not meet the qualification requirements characteristics, for which the special provisions contained in the section " General provisions» Qualification characteristics of the positions of education workers.

So, paragraph 9 of the section "General Provisions" of the Qualification Characteristics of the Positions of Educational Workers provides that persons who do not have special training or work experience established in the "Qualification Requirements" section, but who have sufficient practical experience and competence, performing qualitatively and in full the duties assigned to them, on the recommendation of attestation commission can be appointed to relevant vacancies in the same way as persons with special training and work experience.

Positions of employees in the libraries of institutions and their functional responsibilities

When deciding on the staffing (names of vacancies) of libraries of institutions, it is necessary to take into account the differences in the duties of librarians and teacher-librarians.

The duties of librarians are determined by the qualification characteristic approved by the order of the Ministry of Health and Social Development of Russia dated March 30, 2011 No. 251n “On Approval of the Unified Qualification Reference Book for the Positions of Managers, Specialists and Employees, Section “Qualification Characteristics of the Positions of Workers in Culture, Art and Cinematography”” (registered with the Ministry of Justice of Russia on May 24, 2011). 2011, registration number 20838).

It should be taken into account that the duties of librarians do not include the performance of pedagogical activities, therefore, if they are actually performed, with the consent of the employees, such pedagogical work should be paid additionally.

For teaching work, library specialists should be paid additional payment in the manner and under the conditions established for teachers or teachers of additional education, depending on its content. At the same time, teaching work carried out in addition to the main work in the same educational institution without holding a full-time position is not considered a part-time job and can be performed during regular working hours with the permission of the head of the institution.

At the same time, it should be specially noted that, at the suggestion of the All-Russian Trade Union of Educational Workers, when agreeing on the draft qualification characteristics of the position of “teacher-librarian”, such functions as the implementation of the educational process in accordance with the main educational program of primary general, basic general , secondary (complete) general education, conducting training sessions. These functions are the direct duties of teachers and cannot simultaneously be included in the job responsibilities of another employee, even if one calls his place “teacher-librarian”, since one of his main functions is to work with the library fund and information resources.

Labor and other rights and obligations of teachers-librarians

According to the order of the Ministry of Health and Social Development of Russia dated May 31, 2011 No. 448n, the section of qualification characteristics of educators, called "Positions of teachers", was supplemented with the position of "teacher-librarian". It means that the vacancy "teacher-librarian" is assigned to the positions of pedagogical workers.

At the same time, classifying the position of a teacher-librarian as a teacher-librarian does not in itself mean that most of the guarantees established for teachers will automatically apply to the employee who will occupy the specified position, since they are determined depending on the position occupied, the type and type of educational institutions and are regulated both directly by the legislative acts of the Russian Federation and other regulatory legal acts of the Russian Federation, which need to be amended in relation to the position of a teacher-librarian.

Therefore, the implementation certain rights established by the legislation of the Russian Federation for teachers, is currently directly dependent on how quickly the necessary additions will be made to the relevant by-laws, and above all:

  • in order of the Ministry of Education and Science of Russia dated December 24, 2010 No. 2075 “On the duration of working hours (norm of hours of pedagogical work for the wage rate) of pedagogical workers” (entered into force on July 4, 2011), which regulates reduced hours of work teachers;
  • Decree of the Government of the Russian Federation of October 1, 2002 No. 724 “On the duration of the annual main extended paid leave provided to teachers” (as amended and supplemented), which determines the duration of the annual main .

In addition, it is also necessary to introduce amendments and additions to other regulatory legal acts that determine the procedure for the implementation of rights and measures social support pedagogical workers, provided for and Art. 55 .

Thus, teachers of educational institutions, in the manner prescribed by the legislation of the Russian Federation, enjoy the right to receive pensions for length of service (early fixed old-age labor pension) until they reach retirement age.

At the same time, a labor pension in connection with pedagogical activity is assigned ahead of schedule if work has been carried out for at least 25 years in institutions and positions provided for in the List of jobs, professions, positions, specialties and institutions, taking into account which an old-age labor pension is early assigned. However, since the vacancy of a teacher-librarian is not provided for by the specified List, work in this position will not be taken into account when assigning this pension. To change the situation, the specified List must be supplemented, and in the case of a positive decision, the work experience required for her appointment for 25 years in certain positions in accordance with the List is required.

Teachers who live and work in countryside, workers' settlements (urban-type settlements), have the right to provide reimbursement of expenses for housing, heating and lighting. The amount, conditions and procedure for reimbursement of expenses associated with the provision of these measures of social support to pedagogical workers of educational institutions of the constituent entities of the Russian Federation and municipalities, are established by the legislation of the constituent entities of the Russian Federation and are provided at the expense of the budgets of the constituent entities of the Russian Federation. Whether teacher librarians will be able to use these measures of social support will depend on the legislative and other by-laws adopted in the constituent entities of the Russian Federation.

If federal educators public institutions the amount of monthly monetary compensation in order to facilitate their provision with book publishing products and periodicals is provided for in paragraph 8 of Art. 55 of the Law of the Russian Federation "On Education", then the teaching staff of state educational institutions that are under the jurisdiction of the constituent entities of the Russian Federation, the specified financial compensation paid by the decision of the authority state power subject of the Russian Federation in the amount established by the specified body, and for teachers of municipal educational institutions - by decision of the body local government in the amount set by the said authority.

In accordance with par. 3 p. 5 art. 55 of the Law of the Russian Federation "On Education", teachers of an educational institution at least every 10 years of continuous teaching work have the right to a long vacation for up to one year, the procedure and conditions for the provision of which are determined by the founder and (or) the charter of this educational institution, taking into account the list of positions, work in which is counted in the experience of continuous teaching work. If the teacher-librarian simultaneously conducts teaching work in the position of a teacher, in order to exercise this right under the specified conditions, it is necessary to provide for this position in this list.

Teachers of an educational institution, in accordance with federal state requirements for a minimum content of an additional professional educational program and the level of their professional retraining, have the right to undergo professional retraining or advanced training at least once every five years. These requirements are established by the federal executive body responsible for the development of state policy and legal regulation in the field of education.

Therefore, federal state requirements should be established for the minimum content of an additional professional educational program and the level of professional retraining of librarian teachers, and educational institutions implementing educational programs for professional retraining or advanced training should develop appropriate programs for librarian teachers, taking into account that in educational institutions of higher professional education do not train such specialists.

Thus, the basic rights of teachers, provided for by the Law of the Russian Federation "On Education", as well as academic, labor and other rights established by others federal laws, standard provisions on educational institutions of the corresponding types and types and other regulatory legal acts, can be extended to librarian teachers. As a rule, this is possible only on the basis of by-laws, the adoption of which must be initiated by the federal executive body implementing state policy in the field of education, as well as other authorized authorities.

In addition, it must also be taken into account that teachers-librarians should be subject to the rights and obligations of teachers, established by law Russian Federation.

Certification of a teacher-librarian

The duties of teachers include the obligation to undergo certification in order to confirm the suitability of the position held, which is held once every 5 years for teachers who do not have qualification categories (first or highest). The procedure for attestation of teachers of state and municipal educational institutions was approved by order of the Ministry of Education and Science of the Russian Federation dated March 24, 2010 No. 209 “On the procedure for attestation of teachers of state and municipal educational institutions” and entered into force on January 1, 2011.

At the same time, it should be borne in mind that, in accordance with clause 18 of the specified procedure, teachers who have worked in their position for less than two years are not subject to certification. Thus, specialists who have held the position of a teacher-librarian for less than two years, as well as those who received the first qualification category during the first two years of work in this position, cannot be presented by the employer for certification in order to confirm compliance with the position held.

Among the rights associated with attestation, one can include the right of a teacher-librarian to undergo attestation to establish the compliance of the level of his qualification with the requirements for the first qualification category, which is carried out on the basis of an application from a pedagogical worker in the prescribed manner. A teacher-librarian has the right to apply with an application for attestation to establish the compliance of the qualification level with the requirements for the highest qualification category no earlier than 2 years after the establishment of the first qualification category. At the same time, a comprehensive analysis of the results of the professional activities of teachers-librarians should be carried out on the basis of the requirements for qualifying categories, as well as taking into account the peculiarities of their activities in the performance of their official duties, provided for by the qualification characteristics.

Conditions for the performance of additional pedagogical work by teachers-librarians

In addition to pedagogical work, which is the responsibility of librarian teachers and is not subject to additional payment, these employees in the same educational institution, if they have the appropriate training, can carry out teaching work in a school subject. Such work, as well as for other employees, may be allowed during the main working hours, since it is not considered a part-time job and payable in the manner and under the conditions established for teachers.

Regulation of the conditions of remuneration of teachers-librarians

Unified wage system for teachers of state and municipal educational institutions, as provided for before January 1, 2005, when applied throughout the Russian Federation tariff scale, not currently installed.

In accordance with Art. 135 of the Labor Code of the Russian Federation, the salary of an employee, including a teacher-librarian, is established by an employment contract in accordance with the current remuneration system for a given employer.

Wage systems, including rates tariff rates, salaries ( official salaries), wage rates, additional payments and allowances of a compensatory nature (including for work in conditions that deviate from normal), as well as systems of additional payments and allowances of a stimulating nature and bonus systems are established by collective agreements, agreements, local regulations in accordance with labor legislation and other normative legal acts containing labor law norms.

Local regulations establishing wage systems are adopted by the employer, taking into account the opinion of the representative body of workers (the elected body of the primary trade union organization of this institution).

The conditions of remuneration determined by the employment contract cannot be worsened in comparison with the conditions established by the labor legislation and other regulatory legal acts containing labor law norms (collective agreement, agreements, local regulations). And the conditions of remuneration determined by the collective agreement (agreements, local regulations) cannot be worsened in comparison with the conditions established by labor legislation and other regulatory legal acts containing labor law norms.

So, in accordance with Art. 144 Labor Code of the Russian Federation municipal institutions should establish wage systems determined by collective agreements, agreements, local regulations in accordance with federal laws and other regulatory legal acts of the Russian Federation, as well as laws and other regulatory legal acts of the constituent entities of the Russian Federation and regulatory legal acts of local governments. These documents must not contradict the norms of federal legislation.

Consequently, appropriate changes should be made to regional and municipal regulatory legal acts on the issues of remuneration of education workers, as well as to collective agreements institutions and regulations on wages in the school.

From the foregoing, it follows that the regulation of the issues of remuneration of teachers-librarians, including when working in rural areas, will be carried out in different ways: taking into account the norms of legislative and other regulatory legal acts of the constituent entities of the Russian Federation and local governments (incl. hours depending on their financial position), as well as taking into account local regulations adopted directly by institutions.

In addition, it should be taken into account that if the system of remuneration for specialists of an educational institution is built on the basis of professional qualification groups for the positions of educators, approved by order of the Ministry of Health and Social Development of Russia dated 05.05.2008 No. is not currently provided for in this order. Consequently, the qualification level is not defined for this position, according to which the differentiation of official salaries (wage rates) of teachers is determined.

Given this circumstance, the All-Russian Trade Union of Education Workers proposed that the Ministry of Education and Science of Russia classify the position of a teacher-librarian as the fourth qualification level professional qualification group of positions of educators, as well as to prepare the necessary drafts of regulatory legal acts related to the regulation of the rights and measures of social support in relation to librarian teachers, which were indicated by the authors in this commentary.
